A former Madison County teacher is accused of sending nude photos of herself to two students and having sex with one of them, court records revealed.
Lyndsey Sherrod Bates was a special education teacher at Madison County High School until she resigned March 29, personnel records show. Two weeks later, the 22-year-old was arrested on five sex crimes charges involving students. Defense attorney Robert Tuten didn’t respond to calls and an email seeking comment.
Assistant District Attorney Tim Douthit said both students were at least 16-years-old, and neither was in special education classes. Douthit said he couldn’t comment further.
Bates is accused of having sex with a 17-year-old male student around February 14, an investigator wrote in court records. In that case, Bates is charged with a misdemeanor count of sexual contact with a student and the felony crime of being a school employee engaging in a sex act with a student younger than 19, records show.
Although 16 is the age of consent in Alabama, the state’s teacher-student sex law says, “consent is not a defense.” The felony crime is punishable by up to 20 years in prison and a lifetime on the sex offender registry.
Additionally, Bates is accused of sending nude photos of herself to the 17-year-old and a second student, court records show. The second student’s age isn’t listed in court records.
The allegations involving the second student are alleged to have happened “on or about 3/29/2019,” court records state. That’s the day Bates’ resignation was effective. It’s not yet clear whether that will affect the case since Bates wasn’t a school employee any longer.
A probable cause hearing is scheduled for May 22.
