A convicted paedophile who raped an eight-year-old girl is to be "released into the community" after serving just nine months behind bars.

Rogelio Acosta Ruiz entered a home in Queensland, Australia, where the child was home alone.

He performed a sex act on the girl, telling her to “think of it like a lollipop”.

In court Ruiz, who is originally from the Philippines, pleaded guilty to charges including rape, indecent treatment of a child under 12 and procuring a child under 12 to commit an indecent act.

In November Ruiz, 35, was handed a three-year sentence which was to be suspended after 12 months. He is due for release back into the community after spending just nine months in custody.

Queensland Attorney-General Yvette D’Ath has announced that she is appealing the sentence, describing it as “manifestly inadequate”.

The local community, and especially the victim's family, are outraged at the lenient treatment according to lawyer Katherine Cora.

Ms Cora, who is acting for the victim’s family, says that the girl may never recover from the trauma of the attack.

“It's definitely a life sentence for her and her family, and we're doing the best we can to support her,” Ms Cora told The Daily Mercury.

“Him going back to the community as a reportable offender comes with obligations, but the community has a right to know,” she added.

Ms Cora is campaigning for Ruiz, who is married, to have his Australian citizenship removed.

She has also said that the case should set a new precedent for convicted immigrants in Australia.

“We are reaching out to [Australian Minister for Home Affairs] Peter Dutton and the immigration minister to consider revoking citizenship of convicted offenders,” she said.

Ms Cora has launched a change.org petition to appeal Acosta’s sentence, which has already collected over 1,000 signatures.

The three year sentence was already way too short.
