House Speaker Nancy Pelosi made a dramatic announcement during her weekly press conference Thursday by telling reporters that she intends to discuss a constitutional measure to remove President Trump from office, following questions regarding Trump's health as he recovers from coronavirus.

The 25th Amendment allows for the vice president to become acting president if is determined that the president "is unable to discharge the powers and duties of his office."

"Tomorrow, by the way, tomorrow, come here tomorrow," Pelosi said. "We're going to be talking about the 25th Amendment."

Pelosi had earlier questioned the status of Trump's health, as well as exactly how long he has had COVID-19.

“I think that the public needs to know the health condition of the President," Pelosi said. "There's one question that he refused to answer … when was his last negative test?" Pelosi said that this information is necessary in order to “make a judgment about the actions that were taken after that.”

"Let us see a date, a time when you last tested negative," she added.

The 25th Amendment requires a declaration of the president's inability from the vice president and either a majority of either the heads of executive branch departments "or of such other body as Congress may by law provide," to be sent to the speaker of the House--in this case, Pelosi--and the president pro tempore of the Senate--currently Sen. Chuck Grassley, R-Iowa.

While the amendment allows for Congress to pass a law that would create a body to sign off on such a declaration, Pelosi would have to convince Senate Republicans to go along with it. Plus, Vice President Mike Pence would also have to sign the declaration as well, which would be highly unlikely.

Trump said during a Fox Business interview Thursday morning that he is "feeling good," and does not believe he is "contagious at all."

During a recent interview on ABC News’ “This Week,” Pelosi was discussing Trump's nomination of a new Supreme Court justice to replace the late Justice Ruth Bader Ginsburg. Pelosi gave a cryptic response when asked whether she and House Democrats would move to impeach the president or Attorney General Bill Barr in an effort to prevent the Senate from acting on the nomination.

“We have our options. We have arrows in our quiver that I’m not about to discuss right now, but the fact is we have a big challenge in our country,” Pelosi said.

Since then, she appeared to rule out impeachment, telling reporters, "I don’t think he’s worth the trouble at this point."

Republicans were baffled by House Speaker Nancy Pelosi’s Thursday suggestion that she might introduce a bill allowing a body appointed by Congress to invoke the 25th Amendment to remove President Trump from office as he recovers from the novel coronavirus.

The 25th Amendment allows for the vice president to become acting president if it is determined that the president "is unable to discharge the powers and duties of his office." Currently, the vice president and cabinet can invoke that amendment.

"Tomorrow, by the way, tomorrow, come here tomorrow," Pelosi said. "We're going to be talking about the 25th Amendment."

Pelosi was referring to a bill she will unveil Friday with Rep. Jamie Raskin, D-Md., that would allow Congress to establish a permanent body to determine whether the president is fit for office: an Oversight Commission on Presidential Capacity. The bill is expected to reflect legislation that Raskin introduced in 2017.

Still, Pelosi would have to convince Senate Republicans to go along with it. Plus, Vice President Mike Pence would also have to sign the declaration as well, which would be highly unlikely.

Trump fired back at “Crazy Nancy” on Twitter. “Crazy Nancy is the one who should be under observation,” he said. “They don’t call her Crazy for nothing!”

Rep. Doug Collins, R-Ga., noted previous attempts by Pelosi to remove Trump from office.

House Speaker Nancy Pelosi on Friday announced legislation to create a commission that would allow Congress to oust a president from office, using the 25th Amendment, a day after she accused President Trump of being "in an altered state" from his coronavirus treatment.

"This is not about President Trump," Pelosi said Friday. "He will face the judgment of the voters. But he shows the need for us to create a process for future presidents."

Pelosi had previewed the new legislation on Thursday, telling reporters that she would be “talking about the 25th Amendment” on Friday -- which allows for the vice president to become acting president if it is determined that the president "is unable to discharge the powers and duties of his office."

She questioned the state of Trump's health and his behavior since being diagnosed with COVID-19 amid an outbreak at the White House.

“The public needs to know the health condition of the president," Pelosi said Thursday, demanding to know his negative test for the virus before announcing he was infected last week.

She said information is needed to “make a judgment about the actions that were taken after that.”

Trump later responded: “Crazy Nancy is the one who should be under observation. They don’t call her Crazy for nothing!”

Under the 25th Amendment, Congress, the cabinet and vice president can strip powers from a president if for some reason he or she is declared unfit under dire circumstances. But that requires a 2/3 vote of both houses.

Section 4 of the 25th Amendment also states that Congress “may by law” indicate that it is believed “the President is unable to discharge the powers and duties of his office.”

The “by law” part is what Pelosi and Rep. Jamie Raskin, D-Md., are proposing Friday.

They have a bill, which would have to be passed by both chambers of Congress and signed by the president, which would set up “the Commission on Presidential Capacity to Discharge the Powers and Duties of the Office.” Prospectively, that commission would adjudicate the president’s viability for office.

Raskin introduced a similar bill in 2017.

While such a bill may pass the Democrat-controlled House, it would seem extremely unlikely to pass the Republican-controlled Senate unless there was a significant development in Trump’s health. However, it introduces a new political narrative just weeks before Election Day.

Trump was admitted to Walter Reed National Military Medical Center last Friday, began a course of treatment, and returned to the White House Monday -- before returning to the Oval Office on Wednesday.

Amendment XXV

Section 1

In case of the removal of the President from office or of his death or resignation, the Vice President shall become President.

Section 2

Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.

Section 3

Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President.

Section 4

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

Thereafter, when the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that no inability exists, he shall resume the powers and duties of his office unless the Vice President and a majority of either the principal officers of the executive department or of such other body as Congress may by law provide, transmit within four days to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office. Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.

But here's the deal, if she's doing this to try to get Trump out of office, then it makes people flock to Trump's defense. They come out in droves to vote for him and Republicans. If she's doing this NOW in anticipation of a Biden victory, then the people are taking notice and it deepens their doubt in Biden as a candidate, driving them to vote for either Trump or a 3rd party candidate like Libertarian candidate Jo Jorgensen, taking votes away from Biden.

Either way, she loses. It doesn't make sense. They call her Crazy Nancy, but I think the actual adjective should be Stupid... Stupid Nancy. Her tactical sense is way off.

If she's doing this NOW in anticipation of a Biden victory, then the people are taking notice and it deepens their doubt in Biden as a candidate, driving them to vote for either Trump or a 3rd party candidate like Libertarian candidate Jo Jorgensen, taking votes away from Biden.

That's a tell that they know they dont need to change anyone's minds, 99% of people who are going to vote have made their minds up. They are 100% banking on mail in ballot fraud and disputing the results of election day, it doesnt even matter for them to try and convince anyone any longer. Brick Wall moment, they dont really give a shit about voters, they know Trump is a threat to their very existence.

there's not going to be too many switches from trump to biden in the next few weeks, but there may be some large swings the other way based on what comes out :D
