A Pennsylvania woman who beat and choked her 11-year-old son because she wrongly thought he had stolen her drugs can’t escape her aggravated assault conviction and prison sentence, a state Superior Court panel decided Monday.

The boy claimed his mom, 35-year-old Sharee Vaughn, assaulted him twice in March 2018 after she couldn’t find her drugs in their Philadelphia home, Judge Jacqueline O. Shogan noted in the state court opinion denying Vaughn’s challenge to her 5- to 10-year jail term.

The second attack ended only when the child escaped, ran away barefoot in the cold clad only in sweatpants and was rescued by a SEPTA worker who called the police, Shogan wrote. She noted the assaults, which Vaughn committed with her bare hands and a leather belt, left the boy with red marks on his neck and bruises on his neck, chest, arms and legs.

On appeal, Vaughn contested Philadelphia County Judge Mia R. Perez’s finding that she had tried to cause serious bodily injury to her son. She claimed her jail term is excessive and unreasonable. She also challenged Perez’s order that she have no contact with any children during the 14 years she will be either in prison or on probation.

Vaughn won only that final argument. Shogan found Perez had no authority to impose the no contact provision because the state parole board is the agency that will determine what restrictions will be imposed on Vaughn once she is released from prison.

In upholding Vaughn’s aggravated assault conviction, Shogan found it is justified by the evidence, including a videotaped statement Vaughn gave to police. Shogan cited Perez’s description that the recording showed Vaughn “confirming unapologetically that she had beaten her son because (she thought) he had stolen her drugs.”

The state judge also pointed to Perez’s conclusion that the prison term is justified by “the nature of the crime, specifically that the assault took the form of a physical beating that resulted in the child…needing to escape his own home and mother and run barefoot in the cold seeking help from strangers.”
