How will parents react when they find out they will be expected to provide workers' compensation benefits, rest and meal breaks and paid vacation time for…babysitters? Dinner and a movie night may soon become much more complicated.

Assembly Bill 889 (authored by Assemblyman Tom Ammiano, D-San Francisco, will require these protections for all “domestic employees,” including nannies, housekeepers and caregivers.

The bill has already passed the Assembly and is quickly moving through the Senate with blanket support from the Democrat members that control both houses of the Legislature – and without the support of a single Republican member. Assuming the bill will easily clear its last couple of legislative hurdles, AB 889 will soon be on its way to the Governor's desk.

Under AB 889, household “employers” (aka “parents”) who hire a babysitter on a Friday night will be legally obligated to pay at least minimum wage to any sitter over the age of 18 (unless it is a family member), provide a substitute caregiver every two hours to cover rest and meal breaks, in addition to workers' compensation coverage, overtime pay, and a meticulously calculated timecard/paycheck.

Failure to abide by any of these provisions may result in a legal cause of action against the employer including cumulative penalties, attorneys' fees, legal costs and expenses associated with hiring expert witnesses, an unprecedented measure of legal recourse provided no other class of workers – from agricultural laborers to garment manufacturers. (On the bright side, language requiring an hour of paid vacation time for every 30 hours worked was amended out of the bill in the Senate.)

Unfortunately, the unreasonable costs and risks contained in this bill will discourage folks from hiring housekeepers, nannies and babysitters and increase the use of institutionalized care rather than allowing children, the sick or elderly to be cared for in their homes. I can't help but wonder if that is the goal of AB 889 – a terrible bill that needs to be stopped.

The part I like is that you need a replacement sitter after 2 hours so the original sitter can take a break :tup:

CHAPTER 1. GENERAL PROVISIONS AND DEFINITIONS


1450. This part shall be known and may be cited as the Domestic
Work Employee Equality, Fairness, and Dignity Act.
1451. As used in this part, the following definitions apply:
(a) "Domestic work" means services related to the care of persons
in private households or maintenance of private households or their
premises. Domestic work occupations include childcare providers,
caregivers of sick, convalescing, or elderly persons, house cleaners,
housekeepers, maids, and other household occupations.
(b) (1) "Domestic work employee" means an individual who performs
domestic work and includes live-in domestic work employees and
personal attendants.
(2) "Domestic work employee" does not include any of the
following:
(A) Any person who performs services through the In-Home
Supportive Services program under Article 7 (commencing with Section
12300) of Chapter 3 of Part 3 of Division 9 of the Welfare and
Institutions Code.
(B) Any person who is the parent, grandparent, spouse, sibling,
child, or legally adopted child of the domestic work employer.
(C) Any person under 18 years of age who is employed as a
babysitter for a minor child of the domestic work employer.

I babysat for a lady when I was young....cut her lawn too.

I think I made 2 bucks per hour, which was big money when you're 14 (back then)


Her condo lawn was literally about 9 feet long by 5 feet wide and she gave me 10 bucks to do it :dance:

The "substitute caregiver every two hours to cover rest and meal breaks" shit boggles my mind!

Are they seriously saying that babysitting of over two hours requires TWO babysitters? Two hours isn't even enough time to get dinner and a movie. Parents have a hard enough time finding one reliable babysitter let alone two for the same night, same family.

I used to babysit the kids across the street. They were 6 and 8 and we basically played Nintendo/Sega/Playstation the entire time. I didn't really consider it work, more like dedicated gaming time that I got paid for.

I used to babysit the kids across the street. They were 6 and 8 and we basically played Nintendo/Sega/Playstation the entire time. I didn't really consider it work, more like dedicated gaming time that I got paid for.

My little guy was an angel....he watched tv quietly and always went to bed at 8pm.Never bitched and asked me to read him a story most nights.He always passed out within a few pages.

His Mom was a single, tall, blond Scandinavian woman who went to 'meetings' at night...dressed to the 9's.I never thought of the single Mom fantasy element ....she was very hot.And I have kicked myself everyday since for being a respectful young guy.

Make that three of us cause I hate my brother too. He went to an Ivy league school and came back with no car (sold it for a bike), a vegetarian, and a hardcore liberal/socialist.

He may be a doctor but his Libertarian/Capitalist younger brother makes way more money :mrgreen:

Wasn't anything too bad on either of our parts. We just got closer as we've gotten older. We look out for each other from time to time and have each other's backs if ever need be.

:thumbsup: my two brothers are frickin awesome. we all beat the shit out of each other growing up, and we're damn good friends these days :) I'd run through a brick wall for either of them.

so much so, I cant even imagine that, lance. that sucks, dude, I'm always sorry to hear people not getting along with siblings.
