PERUGIA, Italy – An Italian appeals court threw out Amanda Knox's murder conviction Monday and ordered the young American freed, a stunning reversal four years after she was jailed for the death of her British roommate.

Knox, 24, collapsed in tears after the verdict overturning her 2009 conviction was read out, her lawyers draping their arms around her in support. Her co-defendant, Italian Raffaele Sollecito, also was cleared of killing 21-year-old Meredith Kercher in 2007.

It wasn't clear how soon Knox could leave Italy but nothing in Italian law would prevent her from returning home, even if prosecutors appeal the acquittal to Italy's highest court, legal experts say.

One of Knox's lawyers, Carlo della Vedova, said he didn't know when Knox would leave Italy. Knox had an outdated passport that had to be renewed, but it's not clear how quickly that could be done or if the paperwork was already completed.

The eight-member jury acquitted both Knox and Sollecito of murder after a court-ordered review of the DNA evidence cast serious doubts over the main DNA evidence linking the two to the crime.

"We've been waiting for this for four years," said one of Sollecito's lawyers, Giulia Bongiorno.

The judge upheld Knox's conviction on a charge of slander for accusing bar owner Diya "Patrick" Lumumba of carrying out the killing. He set the sentence at three years, meaning for time served. Knox has been in prison since Nov. 6, 2007.

The Kercher family looked on grimly and a bit dazed as the verdict was read out by the judge after 11 hours of deliberations. Outside the courthouse, some of the hundreds of observers shouted "Shame, shame!"

The victim's sister, Stephanie Kercher, who was in Perugia with her mother and brother for the verdict, lamented that her sister "has been nearly forgotten."

"We want to keep her memory alive," she said after the verdict.

Yet inside the frescoed courtroom, Knox's parents, who have regularly traveled from their home in Seattle to Perugia to visit Knox over the past four years, hugged their lawyers and cried with joy. Knox herself was so overwhelmed with tears that two guards pulled her arms to escort her out of the courtroom.

Prosecutors can appeal the acquittal to Italy's highest court. There was no word late Monday if they planned to do so.

In Seattle, about a dozen Knox supporters were overjoyed that she has been cleared of the murder conviction.

"She's free!" and "We did it!" they shouted at a hotel where they watched the court proceedings on TV.

Earlier Monday, Knox tearfully told the court she did not kill her roommate. Knox frequently paused for breath and fought back tears as she spoke in Italian to the eight members of the jury in a packed courtroom, but managed to maintain her composure during the 10-minute address.

"I've lost a friend in the worst, most brutal, most inexplicable way possible," she said of the 2007 murder of Kercher, who shared an apartment with Knox when they were both students in Perugia. "I'm paying with my life for things that I didn't do."

Knox and Sollecito, Knox's former boyfriend from Italy, were convicted in 2009 of sexually assaulting and murdering Kercher, who was stabbed to death in her bedroom. Knox was sentenced to 26 years in prison, Sollecito to 25. They both deny wrongdoing.

"I never hurt anyone, never in my life," Sollecito said Monday in his own speech to the jury.

Hundreds of eager observers gathered outside the courthouse ahead of the highly anticipated announcement, joining television vans that have been camped out for more than a week. One hundred reporters were allowed into the subterranean courtroom.

Observers lined the street leading to the courthouse, taking pictures as the two vans carrying Knox and Sollecito from the prison to the court passed by.

Kercher's mother, sister and a brother traveled to Perugia for the verdict. They had expressed worry over the possibility of an acquittal but told reporters as deliberations were under way that they hoped the jury would do the right thing and not be influenced by the media's focus on the case.

The family, however, said it could understand the Knox family's media campaign.

"They fully believe in her innocence. You can't blame them for that," said Lyle Kercher, the victim's brother. "But it's obviously hard for us."

As the verdict was broadcast live, hundreds of reporters and camera crews filled the underground, frescoed courtroom before Knox's address, while police outside cordoned off the entrance to the tribunal.

The trial has captivated audiences worldwide: Knox and Sollecito had been convicted of murdering Meredith in what the lower court said had begun as a drug-fueled sexual assault.

Knox insisted Monday that she had nothing to do with the murder and that Kercher was a friend who was always nice to her. Gesticulating, at times clasping her hands together, the American said she has always wanted justice for Kercher.

"She had her bedroom next to mine, she was killed in our own apartment. If I had been there that night, I would be dead," Knox said. "But I was not there."

"I did not kill. I did not rape. I did not steal. I wasn't there," Knox said.

After the morning court session, Knox relaxed in the prison chapel, playing guitar and singing as she awaited the verdict, according to an Italian lawmaker who visited her in prison Monday.

Also convicted in separate proceedings was Rudy Hermann Guede, a small-time drug dealer and drifter who spent most of his life in Italy after arriving here from his native Ivory Coast. Guede was convicted in a separate fast-track procedure and saw his sentence cut to 16 years in his final appeal.

Lawyers for Knox and Sollecito believe Guede was the sole killer, but the prosecution and a lawyer for the Kercher family say that bruises and a lack of defensive wounds on Kercher's body prove that there was more than one aggressor holding her into submission.

Knox said she had nothing more than a passing acquaintance with Guede, who played basketball at a court near the house, and didn't even know his name. Sollecito, who addressed the court before Knox, told jurors that he did not know Guede at all.

Sollecito was anxious as he addressed the court, shifting as he spoke and stopping to sip water. He said prior to the Nov. 1, 2007 murder was a happy time for him, he was close to defending his thesis to graduate from university and had just met Knox.

The weekend Kercher was murdered was the first the pair planned to spend together "in tenderness and cuddles," he said.

At the end of his 17-minute address, Sollecito took off a white rubber bracelet emblazoned with "Free Amanda and Raffaele" that he said he has been wearing for four years.

"I have never taken it off. Many emotions are concentrated in this bracelet," he said. "Now I want to pay homage to the court. The moment to take it off has arrived."

I've really not followed any of this...I keep seeing snippets of it here and there and have for what seems like years now. I know in England they think this girl is guilty and America sees her as innocent. Do I have that right? I'm clueless as to what this is all about, anyone care to give me a quick and concise rundown?

Three were arrested: Knox, her ex-boyfriend, and a black guy from the Ivory Coast that was allegedly "on the run". Knox and her boyfriend were arrested four days after the event. If I recall corrrectly, it took them months to find the third guy and they had to extradite him from Germany. They had ironclad proof that the third guy did it, arresting Knox and her boyfriend was a matter of convenience for a bunch of keystone cops that didn't want to put any real effort in their jobs. They didn't back down from Knox because they didn't want to risk losing face in the international public eye.

Knox was a casualty of shitty police work. And she'll never have a normal life again because of it.

There was a lot of shit thrown around in the media. This is the danger of 24 hour access to any and all information, you're never quite sure what to trust. There were those out for blood so willing to crucify this girl for no other reason than for the entertainment value. Somebody said once not too long ago something that I'll paraphrase here:

This case had two faces, what really happened, and what was portrayed in the media. There is a huge difference between the two. We all really need to be careful with what we choose to believe when we see or read something regarding criminal cases we don't have first hand knowledge of.

Another stupid aspect to trials, is if the defendant admits to engaging in any unusual sexual practices...somehow courts and the public connect deviancy to murder.


If it was me, I would be in jail for 300 years....

You mentioned this before and I did some searching on the net...poor detective work and lack of other suspects.

I sincerely hope it's not another Karla Homolka and Paul Bernardo scenario.Initially, no believed that the Barbie couple could kidnap and kill young girls for no reason.

Knox to head home to Seattle while prosecutor plans to appeal

Perugia, Italy (CNN) -- After four years locked up in an Italian prison, Amanda Knox will savor her first full day of freedom Tuesday by going home to Seattle.

Knox spent Monday night with her mother and is "calm, at ease," her lawyer Carlo Dalla Vedova said. She is expected to take a flight to the United States sometime Tuesday.

An Italian jury overturned Knox's murder conviction for the 2007 death of Meredith Kercher, a British exchange student and Knox's roommate in Perugia.

Prosecutor Giuliano Mignini said he will appeal the ruling to Italy's High Court.

When the appeal reaches the High Court, the hearing would be very short and dependent on key technical issues and arguments, not a review of the actual trial itself, according to Luiss University law professor, Nicola Di Mario.

Kercher's family said it would support such an appeal, but added it was the state's decision. They await the judge's report explaining why the conviction was overturned.

Meredith Kercher's sister, Stephanie, said waiting for the judge's report is the greatest disappointment.

"Until the truth comes out, we can't forgive anyone," she said.

Kercher's brother Lyle said the family feels like it is "back to square one. The search goes on as to what truly happened."

He said the Kerchers would not be receptive to outreach from Knoxes yet because further appeal is still possible, and it would be strange to start a dialogue now.

Knox and Kercher were students at Perugia's university for foreign students when Kercher's semi-naked body was found stabbed and with her throat slashed in the house they shared.

Monday's ruling prompted a wave of euphoria by Knox, her family and supporters as well as howls of disapproval outside the courtroom.

"Perugia is a quiet town. The fact that people came and cry out loud 'shame' on the ruling means something," Mignini said.

After the ruling, Knox broke down sobbing and was escorted out of the courtroom by two people.

"We're thankful that Amanda's nightmare is over," Knox's sister, Deanna, said on the courthouse steps. "She suffered for four years for a crime she did not commit."

Knox and her Italian ex-boyfriend Raffaele Sollecito were convicted in 2009 of murder, sexual assault, possession of a weapon, interfering with a crime and theft. The jury cleared both Knox and Sollecito of those charges, freeing them from their respective 26- and 25-year sentences.

A third person, drifter Rudy Guede, was convicted separately of involvement in the killing and is serving 16 years. Defense teams for Knox and Sollecito have suggested Guede could have been the sole killer.

But the jury Monday upheld Knox's conviction on the charge of defamation against Patrick Lumumba, an early suspect in the case whom Knox accused of killing Kercher.

Lumumba was arrested, but released after his alibi checked out. He later sued Knox, winning 40,000 euros ($54,000) in damages. Knox was sentenced Monday to three years on the defamation charge, but received credit for the years she has already spent behind bars, her attorney said.

As the rulings were read in court, Kercher's family grew emotional.

"We respect the decision of the judges but we do not understand how the decision of the first trial could be so radically overturned," the Kerchers said in a statement Monday, issued through a journalist close to the family. "We still trust the Italian judicial system and hope that the truth will eventually emerge."

The jury evidently believed Knox's impassioned final statement to the court, delivered in a voice trembling with emotion.

"I am not what they say I am -- perverse, violent. ... I haven't murdered. I haven't raped. I haven't stolen," Knox said in the most important speech of her life.

Sollecito put his claim simply in his own closing statement.

"I have never hurt anybody," he said.

As he concluded, he dramatically removed his plastic "Free Amanda and Raffaele" bracelet, saying: "I have never taken it off since it was given to me. ... I think now is the moment to take it off."

Following the rulings, Knox returned briefly to the prison and was greeted by cheers and shouts of "well done," said Rocco Girlanda, a member of the Italian parliament who became an advocate for the 24-year-old American. Knox headed to meet her parents nearby after leaving the prison, Girlanda said.

"Her first desire is to lie down on a green field."

The problem is the U.S. and Italy have a bilateral extradition treaty, so if the Italian higher court agrees to allow the prosecutor's appeal to move forward, she's gonna have to go back if the court finds in the prosecutor's favor whether she wants to or not.

I heard many lawyers on several different networks all say they doubt the US would extradite her should the Italian high court overturn this acquittal.

I think they wouldn't on principal alone...there is no way she would have even been brought to trial in the US with the "evidence" the Italian cops had.

she could always do a polanski and fight the extradition for a long time until the statute of limtation kicks in. Apparently that's what Berluscon and his mobster friends do all the time, they use delay tactics and with the italian justice system being inefficient as it is, they usually manage to gain about ten years' worth of delay.

I'd take the village in Tuscany. That's by far the most beautiful part of Italy.

Wise choice. Sicily and Calabria are very beautiful, too, but I guess that the omnipresent organized crime might make it a little uncomfortable to be seen as a wealthy foreigner down there.

Read this book, you will literally be shocked at how the Italian justice system can be f*cked. It's a true story and the whole time I'm reading it I'm just shocked by how ridiculous the case gets
