NEW YORK (AP) — A New York judge has upheld the city's dismantling of the Occupy Wall Street encampment, saying that the protesters' first amendment rights don't entitle them to camp out indefinitely in the plaza.

Supreme Court Justice Michael Stallman on Tuesday denied a motion by the demonstrators seeking to be allowed back into the park with their tents and sleeping bags.

Police cleared out the protesters in a nighttime sweep early Tuesday. The judge upheld the city's effective eviction of the protesters after an emergency appeal by the National Lawyers Guild.

The protesters have been camped out in privately owned Zuccotti Park since mid-September. Mayor Michael Bloomberg said he ordered the sweep because health and safety conditions and become "intolerable" in the crowded plaza.

Over here they are still in St Pauls grounds

but the courts are deciding to evict them soon

It's very much a free country ;)

The US Constitution allows citizens to peaceably assemble to protest things...it does not however give you the right to permanently camp out on public property ;)

We ALL break laws but when they don't infringe on yourself it does not seem to matter

Again - moot point. I don't get how you equate that having laws means we don't live in a free nation.

I hate answering a question with a question but was there a law in place before the occupation of wall street ?

Yes, you need a permit for the type of demonstration they were having....yet they never got the permit, therefore they were breaking the law ;)

sorry OWS, where's your permit again?

First amendement rights are one thing, the city's laws are another. Following the city's laws and getting a required permit isnt necessary for the things to be voiced, but it IS necessary for continued occupation of both public & private property here.
