NEW YORK (Reuters) - The New York City Police Department's controversial "stop and frisk" crime-fighting tactics violate the U.S. Constitution, a federal judge ruled on Monday.

U.S. District Judge Shira Scheindlin said the city police adopted a policy of "indirect racial profiling" by targeting racially defined groups for stops.

The practice resulted in disproportionate, discriminatory stopping of blacks and Hispanics that the city's highest officials "turned a blind eye" toward.

"No one should live in fear of being stopped whenever he leaves his home to go about the activities of daily life," Scheindlin wrote in her opinion.

The class action was considered the broadest legal challenge to stop and frisk, a tactic in which city police stop people they suspect of unlawful activity and frisk those they suspect are carrying weapons.

Scheindlin's decision follows an exhaustive nine-week trial that pitted the NYPD's interest in keeping New York's crime rate down against black and Latino plaintiffs who felt discriminated against. Scheindlin presided over the trial without a jury.

As part of her ruling, Scheindlin ordered the appointment of an independent monitor to oversee compliance with other remedies she ordered.

The NYPD did not immediately comment on the decision.

for argument's sake.....if there's a group of 100 people, various colors and race. And statistics say that over 70% of a certain color/race within that group commit crimes, is it profiling to search that group, or it is statistical bias with proof?

I article I read said that the original intent was to reduce murders. 80% of the murders in NYC are committed by minorities, mostly black. 80% of the people stopped and frisked were minorities. I don't consider that discriminatory. If it were 50% committed the crime and 80% stopped, then they'd have a point. Profiling is not automatically a bad thing.

Like it or not, It's a citizens constitutional right to NOT be treated this way.

I may never agree with anything else this Judge decides, but this is absolutely correct. You CAN NOT stop and search someone for a "suspicion"

It should be required for everyone in all levels of government to memorize the U.S. Constitution before they apply for their jobs.

Yes, we shouldn't racially profile because people might get their feelings hurt, so by all means in cities like Chicago and New York and LA, don't be pro-active, wait until some punk gangbanger does his drive-by and his stray bullets kill some kids and their grandma....and at all airports, make sure you let Mustaffa thru, but check the 95 year old lady in a wheelchair and better confiscate the miniature toy sword from the 5 year old carrying his Teenage Mutant Ninja Turtle toys, because as we all know, those are the real threats out there.

Better to be sensitive to people's feelings instead of saving a few lives right? :thumbsup:

I said nothing like that. What I meant is that the judge is indeed right. Police can not stop or frisk folks arbitrarily. We all seems to agree on the 1st and 2nd amendments, why no support for the 4th?


The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

While I will absolutely agree that there is a certain portion of our population that commits the majority of violent crime, I think that unlawful search on people that may happen to be part of that portion, is yet another step down the road to a totalitarian future that I for one will fight tooth and nail to stop.
Who's to say that just because a cop may think you are a gun owner, he wouldn't stop and search you on a whim?
