A man who had contributed money to buy beer along with his friends became angry when he did not get any change back and fatally shot one of those friends and critically wounded another over the weekend, officials said.

Gumaro Torres, 31, was ordered held without bail after being charged with the shootings that happened on Aug. 16, at about 11:30 p.m., officials said in court today. He was charged with first degree murder, attempted first degree murder and aggravated battery with a deadly weapon.

Torres was at a home on the 1800 block of North Pulaski Road where Torres and the other members of the group, including Jose De LaFuente, were sitting at a picnic table in the yard, prosecutors said.

After drinking several beers, Torres became angry about beer money and began a verbal argument, prosecutors said.

A short while later Torres left the group and went to his home on the same block and returned with a loaded 9mm semi-automatic handgun, prosecutors said in court.

"He stated that he was angry that when he returned the victims laughed at him," prosecutors said.

As soon as he returned to his group of friends he "immediately began to fire his gun at Jose De La Fuente," prosecutors said. De LaFuente was struck in the abdomen and later died at Mount Sinai Hospital, prosecutors said.

As Torres fired, another friend tried to stop Torres from shooting but as he approached, Torres turned the gun on him, prosecutors said.

The friend was shot in the hand, abdomen, leg and right hip, and was taken in critical condition to Mount Sinai where he remains, officials said.

After shooting the friend, a third man was able to subdue Torres. As Torres struggled, he pistol whipped the third friend several times in the head with the butt of the gun.
