FARMINGTON — A Davis High School teacher was charged Tuesday with having sex on multiple occasions with a former student.

Brianne Land Altice, 34, was charged in Farmington's 2nd District Court with three counts of rape, a first-degree felony.

A boy told police that between Jan. 1 and Sept. 30, when he was between 16 and 17 years old, he had sexual intercourse with Altice on three different occasions, according to charging documents.

"The defendant occupied a position of special trust in relation" to the juvenile, prosecutors wrote.

Altice was originally arrested in October. Altice was believed to have had sex with a 17-year-old on many occasions, including at her South Weber home and at a park, a Davis County Jail report states.

The teen was allegedly able to accurately describe the layout of Altice's home to detectives as well as tattoos on her body.

The Davis County District Attorney's Office said Tuesday there were still "pending investigations" ongoing that involved other potential victims.

Altice was placed on administrative leave by the school district in October pending the outcome of an investigation.

She started teaching in the district in 2004 as a prep time specialist at Wasatch Elementary School. In 2005, she was hired as an English teacher at Sunset Junior High. In August of 2012, she was hired as an English teacher at the high school.

Altice's husband filed for divorce in November, according to court records.

A 34-year-old Utah high school teacher accused of having sex with a 16-year-old student claims she is the victim because the boy 'wore down her defenses.'

Lawyers for Brianne Altice asked a judge to throw out three counts of first-degree felony rape and one count of first-degree felony forcible sodomy against the teacher on Tuesday.

They say the boy admitted he set out to have sex with Altice and that it was therefore legally consensual. It is illegal in Utah for a teacher or anyone in a position of power to have sex with a person under 18.

'She repeatedly refused and declined his advances until he ultimately broke down her resistance,' defense lawyer Edward Brass claimed, according to the Salt Lake Tribune.

'The state failed to establish probable cause to believe that the intercourse that occurred was without consent.'

However, Judge John R. Morris threw out the motion - saying that there was probably cause the try Altice. He set a September trial date.

The statuesque blonde former English teacher at Davis High School in heavily Mormon Kaysville, Utah, sobbed as she left court on Tuesday with her family.

The 16-year-old boy told investigators in last November that he had had sex with Altice on three occasions in 2013 and testified to that fact at a preliminary hearing in February.

According to the Standard-Examiner the teen said in the preliminary hearing that he was upset because his family had moved to Utah from another state.

He said he was having problems and home and doing drugs and that he would skip class to hang out with Altice.

Altice is the fourth Utah teacher currently facing charges of sexually abusing children.

A former Utah teacher has been ordered to stand trial after a student -- one of three alleged victims of her sexual abuse -- testified that he had sex with her, even after her arrest.

Brianne Altice, 35, who taught English at Davis High School in Kaysville, Utah, is accused of 14 felony charges, including rape, sodomy, sexual abuse and sex with a minor.

The Layton, Utah, student, now 18, testified at a hearing Thursday that he had sex with Altice before and after she was arrested in October 2013 for having a sexual relationship with another student, The Salt Lake Tribune reports.

Teen also testified that he considered her to be his girlfriend during a yearlong relationship involving sexual intercourse and oral sex.

Altice also sent the boy a text message with a photograph of her breasts in June 2014, authorities said.

After hearing testimony from the teen and several other witnesses, Judge John Morris in 2nd District Court found probable cause for Altice to stand trial.

And prosecutors argued she should remain behind bars as she awaited that trial.

'It is a simple argument,' Deputy Davis County Attorney Susan Hunt said. 'While the defendant was on pretrial release, this defendant continued to engage in sexual misconduct with a 17-year-old boy.

Her willingness to continue to commit felony sexual offenses while on bail causes great concern that this defendant will continue and be a danger to the community.'

Her own attorney argued she was no danger because of the alleged victim's age, reports the Tribune.

'She doesn't present a danger to anyone,' attorney Edward Brass said. 'That young man is an adult.

In the end, the judge ordered Altice to stay jailed. Bail had been revoked after allegations she had sex with the third victim following her arrest.

The judge also decided, this time in favor of the defense, that Altice would be tried separately in each student's case--meaning she'll get three different trials.

The defense had argued that bundling the cases, as the prosecution want to do, would have be prejudicial to Altice's case, Fox 13 Salt Lake City reports.

The teen on the stand said he was 'unhappy' to be required to testify against Altice. He said their relationship halted after he was arrested for witness tampering and retaliation against a witness in the case.

'It's ridiculous,' he said. 'She doesn't deserve to be here.'

Altice was arrested in December 2013 after a boy, 16, told police he had several sexual encounters with her. In October, another teen said he had also had sexual intercourse with her after they began kissing between class periods.

Altice, who faces up to life in prison if convicted, was fired from her teaching job last year.

Altice's attorney has said his client denies any romantic involvement with the three students.

'It is her defense that they did not happen at all,' he wrote in a motion. 'That she never engaged in any inappropriate contact with either of her students.'

But prosecutors said the teacher acknowledged to investigators that she had engaged in sex with the 16-year-old boy on two occasions.

The teen was allegedly able to accurately describe the layout of Altice's home to detectives as well as tattoos on her body.

A Utah teacher serving time after she admitted to having sexual contact with three of her students defended her actions from behind bars while lashing out at the parents of one of her teenage victims.

Brianne Altice, 37, of Salt Lake City responded to a lawsuit filed against her and the Davis School District in December by one of her victims and his parents saying that they failed to attend her parent-teacher conferences and that their son often complained about his strained relationship with the two.

She also shot down claims that she wore 'risque' clothing in the classroom saying that there she had never received any complaints about her work attire.

Altice, who is serving a minimum of two years in prison after pleading guilty last April to three counts of forcible sexual abuse, also said that she had no 'evil or malicious intent' by having sexual contact with her three victims.

Fighting back: Altice responded to a lawsuit filed against her by one of her victims in a letter submitted to the court saying the boy's parents never attended parent-teacher conferences

Altice said she wrote the two-page letter that was submitted to the court last month in response to the lawsuit because she cannot afford legal counsel.

In the letter, obtained by The Salt Lake Tribune, she also responded to allegations that she allowed the boys to skip class and hang out with her, saying that she frequently let both male and female students spend time together in her classroom before and after school and during their lunch hour.

The initial complaint claims that employees at the school told administrators about Altice's inappropriate behavior with male students and they chose to ignore the problem.

Attorneys for the school district have denied this claim.

The lawsuit also claims that Altice's rampant romps were so blatant that the question 'Who is Ms. Altice sleeping with now?' became a running joke throughout the school.

The young man who filed the lawsuit was 16 years old the first time he engaged in sexual contact with Altice.

According to Altice's letter the boy would often help 'thwart inappropriate comments directed at her'.

She said her victims would also frequently tell her 'you’re hot' and 'you’re sexy.'

In December, a state court judge also tossed out a lawsuit filed by one of Altice's other victims.

A school district attorney argued that the district is immune from liability under state law that exempts state entities for physical and emotional harm suffered as the result of physical battery.

Police say Altice befriended the boys while they were students, eventually progressing to three separate sexual relationships, meeting the teens for sex at parks, in cars and at her home while her husband was away.

She has since divorced.

The disgraced teacher had sexual relationships with the boys for months, going on picnics and dates with the students.

The lawsuit seeks an unspecified amount in damages for physical, mental and emotional pain and expenses for counseling, therapy and related care and treatment. It also seeks punitive damages against Altice.

A trial date has not been set at this time.

A second victim had also filed a suit against Altice and the school district claiming that the teacher took advantage of the fact that the teenager had been sexually abused and had a troubled past.

That suit also alleges that the school district knew about the Altice's relationships and failed to protect the students.

Altice admitted to touching the genitals of her three victims in 2013, while all three of the young men said they had sex with the teacher.

In exchange for the plea, Davis County prosecutors dismissed 11 other felony charges, including first-degree felony rape.

At her sentencing, she said she was emotionally damaged and made mistakes by giving into her teenage students' advances. She will have her first parole hearing in January 2017 and could ultimately be facing 30 years in prison.
