View Full Version : Driver Who Struck and Killed Canadian Teen Sues His Family for $1.35M

A woman who struck and killed a teen with her SUV over a year ago in Ontario, Canada, is suing the victim's family for more than $1 million, attorneys said Friday.

Brandon Majewski, 17, died after he and two of his friends were hit while riding bikes in the early morning hours of Oct. 28, 2012, reported Canada's CTV News.

SUV driver Sharlene Simon claimed she didn't see the boys in the dark, and police did not charge her after they found no wrong-doing on her part, her lawyer, Michael Ellis, said in a statement.

Majewski's parent's recently learned Simon is seeking $1.35 million in damages "for the ‘pain and suffering’ she sustained after taking the teen’s life," family lawyer Brian Cameron said in a statement.

Simon is also suing the families of the other two boys she struck and the County of Simcoe, where the accident occurred, CTV News reported.

Ellis said that his client is also a "victim."

"Ms. Simon has been unable to return to work since the collision," Ellis said. "She relives the terror of this incident every day."

But the teenager's parents are devastated by Simon's actions.

"She says she’s in pain? Tell her to look inside my head and she will see pain, she will see panic, she will see nightmares,” said Brandon’s mother, Venetta Mlynczyk, according to the Toronto Sun.

The boy's family also filed suit against Simon shortly after the accident, Ellis said.

The last sentence of the article explains her counter suit actions, she was being sued for something that wasn't her fault.
At least she gave the others a year to recant theirs.

That's an awfully big leap in logic. The article didn't connect the family's civil litigation against her as a reason why she's suing them. The stated reason is in the middle of the article, and it makes her look like a complete and total douchebag.

It states that authorities found no wrong doing on her part and that the family filed suit shortly after the accident.

Yeah, but that happens all the time. Just because criminal charges aren't filed, that doesn't mean liability doesn't exist. A civil suit frequently has lesser standards to prove liability for an action, so even when criminal charges aren't filed, or if someone gets tried for a criminal act and exonerated, they'll still have the civil suit to deal with afterwards.

Now granted, even though they're suing her, it doesn't guarantee that they're going to win, but it's how the legal system works: if you can or cannot get what you want via criminal proceedings, use civil litigation to get satisfaction or to punish them even more.
