A gay South Dakota teenager allegedly forced by his boss to wear a name tag that read "gaytard" filed a complaint with the Equal Employment Opportunity Commission this week, claiming his former employer discriminated against him and violated his civil rights.

The Argus Leader reports the teen, identified as 16-year-old Tyler Brandt, was allegedly forced by a night manager at Taco John's International restaurant to wear a name tag that read "gaytard" during his June 23 shift.

Brandt reportedly complied, fearing he'd lose his job if he didn't wear the name tag. The teen, who is openly gay, claims he was mocked in front of restaurant customers when he asked to remove the tag. He resigned the next day, according to the newspaper.

Brandt filed a complaint with the Equal Employment Opportunity Commission this week with the help of the American Civil Liberties Union of South Dakota, alleging the restaurant in Yankton, S.D., violated the Civil Rights Act of 1964. He also created a website hoping to bring attention to bullying in the workplace.

"What happened to me was so incredibly humiliating," Brandt told the newspaper. "My hope is that this filing results in a policy to ensure that no other Taco John's employee will ever experience this kind of harassment."

The CEO of Taco John's International, meanwhile, said the company would fully cooperate in the investigation into the incident, according to the paper.

"We at Taco Johns are deeply concerned about the reported incident in Yankton," CEO Jeff Linville said in a statement to the newspaper Wednesday. "At Taco John's International, Inc., we believe everyone should be treated with dignity and respect, and in response to Tyler's complaint, we share his belief that discrimination is wrong."

Interesting law suit. Sexual orientation is not covered under Title VII, so the basis for the claim will have to be that sexual stereotyping makes is a gender discrimination claim.

For those interested, this is a very new tactic. The law has been stretched by the current administration to attempt to force fit sexual orientation into gender discrimination.

As we know, according to our current king, there is no need to pass actual laws that get voted on when you can use your agency power and executive orders to get what you want.
