A man and his young son went home Saturday night and found an alleged burglar who reportedly offered to share his heroin, according to prosecutors.

Christopher Dayell Bittner, made an initial court appearance Monday on felony burglary and drug possession charges.

“He was apologetic and offered the homeowner heroin before he left (the house),” Deputy Yellowstone County Attorney Paul Adam said. “However, he was found with several items that appeared to be stolen.”

Deputies arrested Bittner on Saturday after a homeowner reported his Orchard Lane home had been burglarized, court papers say.

Bittner was found at the intersection of Orchard Lane and Southwest Ellington Avenue, where he had a backpack and its contents strewn across a yard.

Bittner said he was reorganizing his backpack and “claimed the items belonged to him and his recently deceased father,” an affidavit says.

The homeowner identified a sweatshirt, art box and face cream that had been stolen, and said he found a back window open and that property inside the house had been thrown around.

The man said he and his 7-year-old son came home and found Bittner leaving the house. When confronted, Bittner reportedly said he was looking for some items to borrow and tried to sell the homeowner a guitar he apparently had with him.

Bittner then went on to apologize and offer the homeowner some heroin, court records say.

Bittner gave the deputies permission to search his backpack. They reportedly found 31.5 grams of a hard black substance — identified as heroin — in a tin that was inside an eyeglasses case.

They also reported finding seven syringes, a spoon, a pill cutter, pill grinder and other alleged paraphernalia. Deputies also found a Crown Royal bag containing a screwdriver, two wire cutters, screwdriver bits, retaining ring pliers and a “tiny power drill,” court records say.

Noting the seriousness of the allegations, Justice of the Peace David A. Carter set bond $7,500, as requested by prosecutor Adam during Bittner’s initial appearance.

Assistant Public Defender Roberta A. Drew had asked that Bittner be released without bail, partly because his father died days ago and Bittner wants to be able to attend the funeral.

Carter agreed to allow Bittner to be released for a few hours for the funeral on the condition that he where a GPS monitor.

Bittner, who also faces misdemeanor charges of burglary tool possession and drug paraphernalia possession, is scheduled to be arraigned in Yellowstone County District Court on Oct. 16.
