Five underage students from a Florida high school have been charged with the gang rape of a 16-year-old girl on Nov. 13.
Two of the students -- Deoante Stewart, who turned 17 the day of the alleged assault, and Marquis Pierre, who was 16 at the time but is now 17 -- are being tried as adults. The other three are being arraigned in juvenile court today, the Orlando Sentinel reports.
A sixth suspect has not been charged. He is the only adult -- 18-year-old Torreano Batton. He’s due back for an arraignment today as well.
The six were arrested when a 16-year-old girl told police that they sexually assaulted her in a patch of woods near Winter Springs High on Nov. 16.
She told police that three of the suspects raped her when she was walking back from the school to a nearby McDonald’s. She was raped again on her way back when two of the boys found her and pulled her into the woods where others were waiting, according to the police report.
The girl was able to film part of the attack on her iPhone. According to the police, the video shows the boys asking her to perform sexual acts and her telling the boys, “No,” and that she wants to go back to school.
“The males are circling her and appear to be trying to intimidate her into performing the acts and keeping her from leaving,” according to the police report.
Two of the suspects assaulted her twice, she said.
Three of the suspects claim that the act was consensual and two denied to have taken part.
Batton told police he was not involved, and was released with a $35,000 bond. He was ordered to wear a GPS monitor and told to stay away from the school.
If convicted, the juveniles would be in juvenile detention until they turn 19. The adults -- since they are “youthful offenders” -- would only serve four years in prison, reports the Orlando Sentinel. The maximum sentence for their charges is 30 years.
