A rapist was ‘distressed and upset’ after finding out the man he had raped was HIV-positive.

Philip Donald Jason plead guilty to rape, theft, and common assault after he ‘crossed a line’ while having sex with another man in Brisbane in June last year.

Sexual consent was initially given, but the victim later asked him to stop.

This was Jason’s first sexual encounter with a man and the 48-year-old continued to have unprotected sex with him despite consent being withdrawn.

After being arrested, Jason was told his victim was HIV-Positive – and he was said to have become very upset.

Andrew O’Brien, his defence lawyer, told the court: ‘He was first made aware of that after he was arrested … and he was obviously distressed and upset.’

Jason then underwent six months of medical tests before being given the all-clear.

Mr O’Brien argued that the distress caused by the HIV scare should be taken into account during sentencing.

Judge Fleur Kingham disagreed, saying: ‘It’s a consequence of him consensually engaging in unprotected sex.’

Jason, who was said to have a significant criminal history, was sentenced to two and a half years in jail. This was his first sexual offence.
