Subway's former spokesman Jared Fogle has agreed to plead guilty to sickening charges of child pornography and traveling for sex with minors, including a 17-year-old escort he took to the Plaza Hotel and the Ritz.

According to documents released by the US Attorney's Office Wednesday morning, the 37-year-old has admitted to one count of travel to engage in illicit sexual conduct with a minor and one count of distribution and receipt of child pornography.

Among the allegations laid out in the document are that Fogle traveled to New York City to pay for sex acts with minors while he stayed in upscale hotels, and that he knowingly received child pornography secretly produced by Russell Taylor, then-director of his charity, the Jared Foundation.
Meanwhile, Fogle's second wife, Katie, released a statement through her attorney announcing that she is divorcing him.

'Obviously, I am extremely shocked and disappointed by the recent development involving Jared,' the statement read.

'I am in the process of seeking a dissolution of the marriage. My focus is exclusively on the well-being of my children.'

The news release was made public as Jared Fogle was making his initial court appearance before Federal Magistrate Judge Mark Dinsmore.

The hearing lasted less than 15 minutes and was strictly procedural. He is expected to officially plead guilty on a later date.

Fogle sat with his hands clasped and quietly answered 'no' when the judge asked whether he had any questions about his rights. He was then ordered placed under home detention with GPS monitoring.

Under the plea agreement filed by prosecutors this morning, they will not ask for a sentence greater than 12 and a half years in prison, while Fogle's defense will not seek a prison term shorter than five years.

Fogle also will be required to register as a sex offender, undergo treatment for sexual disorders and pay $1.4million in restitution - $100,000 for each of the 14 minor victims.

In the wake of the news, Subway issued a one-line statement on its Facebook and Twitter pages late Tuesday distancing itself from Fogle, who was suspended as the company's spokesman last month after the FBI raid on his home.

'We no longer have a relationship with Jared and have no further comment,' the message read.

According to the newly released documents, Fogle's sexual activities involving minors may have started in 2007, and that some of the victims in the case were as young as 13 and 14.
Prosecutors state that Fogle knew that the children depicted in sexually explicit photos and videos he was receiving from Russell Taylor were younger than 18, and he approved of his associate's side job as a producer of child pornography.

The court papers further state that beginning in 2007 and continuing until late June 2015, Fogle used social media and websites containing ads for escorts to hire the services of sex workers.

Between 2010 and 2013, the 37-year-old millionaire Subway spokesman repeatedly traveled from Indiana to New York to have sex with underage prostitutes.

On one occasion in the fall of 2012, the documents state, Fogle hired a 17-year-old girl for sex and brought her to the Plaza Hotel where he was staying as a guest.

The following day, he texted the teenage escort offering to pay her a finder’s fee if she could procure for him an underage girl for sex, saying, 'the younger, the better.'

Fogle continued to persist with his requests, telling the 17-year-old that 'he would really make it worth her while' if she could find him a young teen for sex.

At Fogle's request, the teenage escort later emailed him three nude photo of herself showing her genitals.

In January 2013, Fogle again met up with the underage prostitute in New York, this time taking her to the Ritz Hotel for a tryst in exchange for cash.

According to the court filings, Fogle also approached other escorts from Virginia, Missouri and Nevada asking to connect him to minors as young as 14 and 15, but only after having sex with them to make sure they were not undercover police officers.

To cover up his illicit activities, the married Subway pitchman made sure his getaways to New York for sex coincided with legitimate business trips.

The revelations come one month after feds executed a dawn raid on Fogle's home in Zionsville, Indiana, seizing electronic equipment.

One month before that, the executive director of the Jared Foundation - Fogle's organization that aspires to combat childhood obesity - was arrested in Indianapolis on federal child pornography charges.
Documents seized as part of the investigation into the former executive, Russell Taylor, claim Fogle bragged to a business colleague about having 'amazing' sex with a 16-year-old girl.
In a series of texts he told the female franchisee to advertise herself on Craigslist for sex, according to the documents seen by Business Insider.

The messages have now been subpoenaed by the FBI in connection with federal child sex abuse allegations.

She reportedly replied: 'Is this the same website you found that 16 year old you that you f---ed?'
'I still can’t believe you only paid $100 for her.'

Fogle, who was based in Indiana where the age of consent is 16, said: 'It was amazing!!!!'

She responded: 'What part of her ad made you think she was selling sex?'

And Fogle concluded: 'U will have to read them to see.'

The woman, who asked to remain anonymous, claims she showed the texts to management in 2008 but nothing was done. Business Insider reports that no record was made of her complaint.

Her attorney said: 'She also specifically warned them that he should not be interacting with young people.'

The revelation comes after Taylor, Fogle's former colleague, was accused of asking a woman if he could have sex with one of her horses.

In court papers filed in the case against Taylor, a woman identified as Jane Doe claims that Taylor asked if he and another woman could come to her house and engage in a three-way with the animal.

The woman, who refused Taylor's request, claims she was asked as she boards horses at her home.

'Jane Doe stated Russell Taylor asked her if he and another adult female she identified could come to Jane Doe’s residence and engage in sexual activity with a horse,' the document reads.
The woman also claims that Taylor sent her a photo 'that depicted a dog licking the nude genital area of an adult female.'

NY age of consent is 17. However, federal law states that age of consent is 18. He crossed state lines to commit the act which puts it within federal jurisdiction.

Chapter 117, 18 U.S.C., 2423(b) forbids traveling in interstate or foreign commerce to engage in "illicit sexual conduct" with a minor.

It's a federal crime. If you commit a crime inside your state of residence, the state handles the case, but anytime you commit a crime across state lines, it becomes a federal issue subject to federal laws and definitions.

Yes, it is. He'll do his time in a federal prison, inall likelihood with other child porn offenders in a segregated medium-security facility.
