LOS ANGELES – Paul Walker's daughter sued Porsche for wrongful death Monday, claiming the sports car that her father was in when he was killed suffered from numerous design defects.

The lawsuit filed by Meadow Rain Walker seeks unspecified damages for defects that her lawyers claim kept the actor trapped in the Porsche Carrera GT when it crashed and burst into flames in November 2013.

Walker was on a break from filming the seventh film in the "Fast & Furious" franchise when he was killed. He was riding in the Carrera GT driven by friend and business associate Roger Rodas when the car spun out of control, struck three trees and burst into flames on a street in Santa Clarita, California.

The wrongful-death suit claims the car, which was marketed as a street-legal race car, lacked a proper stability control system and safeguards to protect occupants and keep it from catching fire after a collision.

"Absent these defects in the Porsche Carrera GT, Paul Walker would be alive today," the lawsuit states.

An email sent to representatives of Porsche Cars North America was not immediately returned.

The 18-page lawsuit includes a detailed recounting of the crash and contends that the Porsche was traveling 63 to 71 mph (101 to 114 kph) when it spun out of control.

Investigators concluded the Porsche was going much faster — up to 94 mph (151 kph) — when it crashed.

The investigation by the Los Angeles County Sheriff's Department and California Highway Patrol concluded that it was unsafe speed and not mechanical problems that caused the crash. That investigation was aided by engineers from Porsche, who evaluated the wreckage of the rare car.

Meadow Walker's lawsuit contends Porsche didn't include a stability control system in the Carrera GT model Rodas was driving but includes it in other models. It also claims the car lacked proper reinforcements in its doors and used rubber fuel lines that didn't break free to prevent a fire in a crash.

Similar allegations of design and safety defects were included in a wrongful death lawsuit by Rodas' widow, Kristine Rodas, that remains pending in a federal court in Los Angeles. Rodas was trained as a race car driver and was only driving 55 mph (89 kph), according to his wife's lawsuit. He left behind two young children when he died.

Walker, the star of the "Fast & Furious" film franchise, co-owned an auto racing team with Rodas named Always Evolving. Meadow Walker, 16, is the sole heir of his estate.

Walker's two brothers helped complete action scenes in "Furious 7," which earned more than $1.5 billion globally after it was released in April.

Yes, cuz it was absolutely Porche's fault the driver was speeding and that the crash happened the way it did. Absolutely.
I guess she just ran out of inheritance, so she's trying to milk it...shameless bitch.

Doubt it, I'm sure its coming from a lawyer who is looking for a payday and convinced her to let him sue on her behalf.

UPDATE: A rep for Meadow Walker tells TMZ, "It is beyond regrettable that Porsche is trying to deflect its own responsibility by blaming the victim -- Paul Walker -- for his own death by getting into the passenger seat of its Carrera GT. Contrary to Porsche's assertions, the facts are clear: Paul was the passenger in a car that was not designed to protect its occupants, in a crash on a dry, empty straightaway in broad daylight and at speeds well below the vehicle's advertised capabilities."

The rep adds, "If Porsche had designed the car to include proper safety features, Paul would have survived, he would be filming 'Fast and Furious 8' and Meadow Walker would have the father she adored."

-----------------------------------------------------------------------------------------------------------------------

Paul Walker's daughter is going to have a fight on her hands with her wrongful death lawsuit, because Porsche has now fired back, saying Paul's death was his own fault.

Porsche has filed an answer to Meadow Walker's suit, saying Paul was "a knowledgeable and sophisticated user of the 2005 Carrera GT." The car company does not elaborate, but they are saying Paul should not have allowed or participated in a high-speed ride under the conditions that existed.

Porsche also takes issue with allegations that the car's design was defective. The car company says "the subject 2005 Carrera GT was abused and altered ..." The company added the car was "misused and improperly maintained."

Porsche makes various claims, some of which if proven would foreclose any recovery of money, but the company also suggests there might be "comparative fault" ... meaning Paul was partly to blame and any damages awarded should be reduced accordingly.

and at speeds well below the vehicle's advertised capabilities.

So.... because my Camry is capable of 120MPH means that if I wreck it doing 115MPH on a road designed for 40MPH it's the car manufacturers fault? GTFOH

not too soon

So what was the story on the crash? They were driving withing city limits, totally speeding and the driver piled into a phone pole? Is it that simple?

I saw some footage where Walker was getting into the car and that was it

If I remember right they hit a tree or pole at around 110 mph on a dry evening / night

Pretty much, they were driving recklessly. I forget the speeds they were going but they lost control, hit the pole and while pinned the car caught fire.

A judge says the widow of a man driving the Porsche that crashed and killed actor Paul Walker cannot prove the carmaker is responsible for the accident.

U.S. District Judge Philip S. Gutierrez ruled Monday that there wasn't enough evidence in Kristine Rodas' claims that her husband died because the Porsche Carrera GT he was driving lacked several key safety features.

Gutierrez also ruled there wasn't evidence the Porsche's suspension failed, as the lawsuit claimed.

Rodas is the widow of Roger Rodas, a friend of Walker's who was driving the Carrera GT when it crashed and burst into flames in Santa Clarita in November 2013.

Her attorney, Mark Geragos, says the ruling will be appealed.

Celebrity website TMZ first reported the ruling Tuesday.
