A company executive who was sacked after footage of him assaulting an Uber driver emerged is now suing his victim.

Benjamin Golden, 32, who was charged after he was filmed slapping, punching and pulling the driver’s hair, says it was an invasion of his privacy.

Edward Caban, the driver, pepper-sprayed Golden after he became aggressive when he was asked to leave the cab because he was too drunk to give directions.

Mr Caban filed for $25,000 damages for distress caused by Mr Golden.

But now he’s fired back saying the use of pepper spray meant he was the one who was assaulted, he can’t get a job, he’s suffered severe emotional distress, he was humiliated, and suffers from anxiety.

Mr Golden told CBS after the incident: ‘It was not me in the video. It was hard to watch and I’m ashamed.’

Mr Caban has not worked for Uber since the incident and has declined to meet Mr Golden.

Mr Golden is looking for work and facing four charges including assault and battery.

How can he say it wasn't him in the video? So his story is that he called Uber, was at that location, but someone else who looks like him got in the Uber instead of him, said they were him, then assaulted the driver? Good luck with that.
