A MARRIED man who accidentally killed his mistress while using a cucumber as a sex toy has avoided jail.

Father-of-one Oliver Dietmann, had placed a cucumber in the mouth of his lover Rica Varna and then went for a cigarette leaving her to suffocate.

The 46-year-old said he and his mistress often used vegetables as a substitute for sex toys and claimed he had no idea she was having breathing difficulties before her death.

Dietmann told the court in Mannheim, southwest Germany, that the couple occasionally used carrots and courgettes.

Ms Varna’s father and sister heard lewd details of the couple’s sex games as they sat in the public gallery.

Dietmann said he had met Ms Varna in 2004 and their relationship turned sexual five years later.

He had invited her round to his place where the cucumber was used "to pleasure her" on July 19 2014.

Dietmann admitted the pair had had drunk four bottles of wine between them and several glasses of schnapps. A post-mortem examination later showed that she was nearly four times over the legal limit to drive a car.

He told the court how after the cucumber had served its purpose he had "put it in her mouth".

Afterwards Dietmann said he smelt burning in the kitchen - and realised he had forgot he had been cooking some meat for his dog.

He said: "I ran to the kitchen, fed my dog and then went on to the balcony to smoke a cigarette."

He said when he returned to the bedroom, Ms Varna was unconscious.

He said: "I tried to get the cucumber pieces out of her mouth, but they were so mushy I couldn't get any purchase at all."

Medical experts later said that the cucumber had got wedged in her throat, cut off her air supply and plunged her into a coma.

Prosecutor Reinhard Hoffmann told the court that Dietman should have realised that she was at risk and should not have left her alone for so long.

Judge Volker Schmelcher said this was clearly a mistake in the circumstances and also a tragic accident.

Dietmann was found guilty of negligent homicide and was handed a 20-month suspended sentence.

He was only ordered to pay a €6,000 (£4,718) fine.

This is ri-dickulous. He should either get life for murder if guilty or nothing if innocent. How is this his fault?
