The case of two people dressed as clowns accused of attacking a teenage girl and her mother with vibrating sex toys in the parking lot of a Montgomery haunted house has been settled out of court, according to Kane County court records.

The terms of the settlement were not disclosed, and the haunted house operators did not admit to any wrongdoing.

An Oswego woman filed a civil lawsuit in October 2014 in Kane County against Massacre Haunted House and two employees, Robert Keller and another male identified only as John Doe, alleging that an experience in the parking lot of the Montgomery attraction left her daughter with emotional and psychological injuries.

The parties reached a settlement during the first week of March, said Michael Huseman, the attorney representing the mother and daughter in the case. The civil lawsuit was officially dismissed Wednesday, according to an order signed by Kane County Judge Mark Pheanis.

Huseman said the plaintiffs were content with the arrangement.

Representatives of Massacre Haunted House could not be reached for comment. Keller, now 25, also could not be reached. In court documents, both Keller and Massacre deny the haunted house ever employed him.

The teen's mother was seeking more than $50,000 plus punitive damages to punish the two people and deter others from similar misconduct, according to the lawsuit.

In the lawsuit, the woman stated she brought four children to the haunted house on a Saturday night a few weeks before Halloween in 2014. They were walking from their car toward the ticket window when two people dressed in clown costumes confronted them while holding sex toys, according to the lawsuit. One allegedly had a teddy bear with a vibrator attached to it.

The unidentified person waved the teddy bear at the teen and simulated sex acts on the toy, the lawsuit alleges. The other clown repeatedly poked the girl with a sex toy and yelled explicit remarks, according to the lawsuit.

The woman and children returned to their car and left without entering the haunted house or buying any tickets. Later that night, Montgomery police charged Keller with misdemeanors in connection with the incident. Keller pleaded guilty to disorderly conduct and was sentenced to 30 hours of community service and 12 months of supervision with required reporting back to court. He was also fined $500, records show.

Keller had no previous criminal charges in Kane or Kendall counties, records show. The other man dressed as a clown has not been identified in the lawsuit.

Massacre Haunted House claims to offer the scariest attractions in the Midwest each year in the 200 block of Montgomery Road in Montgomery.

"This custom built haunted house ... is designed to give mature audiences the scare of their lives," the Massacre website says.

In a separate filing, the haunted house's insurance company, Capitol Indemnity Corp., denied it owed any coverage to Massacre or Keller in relation to the lawsuit because the liability policy does not apply to assault or battery.
