PHOENIX (KPHO/KTVK) -

An attorney has been disbarred from the State Bar of Arizona for allegedly soliciting nude photos as a form of payment from a prospective client.

Attorney Jeffrey D. Moffatt of Lancaster, California was disbarred in April.

During many of his pleadings, Moffatt asserted that he only sought a nude photo of his prospective client to buy time for payment or that he was simply exercising his freedom of speech.

In addition to the nude photo, he reportedly asked his prospective client to commit a criminal offense by soliciting a "surrogate" for him to have sexual relations with, according to Alberto Rodriguez with the State Bar of Arizona.

Disciplinary proceedings revealed several aggravating factors which led to Moffatt's disbarment. He intentionally failed to comply with rules or orders of the Supreme Court and requests from the State Bar of Arizona; failed to attend deposition and sanctions hearing; delayed proceedings by filing numerous motions with nonsensical or unsupported allegations; engaged in deceptive practices; refused to acknowledge wrongful nature of misconduct; and was indifferent to restitution and illegal conduct, according to Rodriguez.

Moffatt's disbarment was effective on April 6. He has appealed the disbarment with the Arizona Supreme Court.
