PHOENIX - Phoenix Police are at the scene of an officer-involved shooting near Deer Valley Drive and 44th Street.

Phoenix police observed a man walking along Deer Valley Road from 40th Street to 44th Street waving a gun at cars as they passed by him.

One of the drivers he waved the gun at was a Phoenix police officer.

The officer confronted the 70-year-old man and he pointed the gun at him and the officer shot him.

Police investigators have determined the gun was a toy gun.

The man went to the hospital with non-life threatening injuries. The 35-year-old police officer is a 12-year veteran of the force and was not injured in the incident.

Deer Valley Drive is closed in the area. A large number of police vehicles are there.
