CHULA VISTA, Calif. - A South Bay man charged with felony assault, kidnapping and domestic abuse related to surveillance video showing a man kicking a woman in a parking lot said he's the victim.
After pleading not guilty to the charges related to the attack, 42-year-old Dorian Chavez Anguiano was taken into custody for violating terms of another felony probation, according to San Diego Superior Court Judge Patricia Garcia.
“In this particular case, he’s on felony probation that adds another element, and the court is going to remand him into custody," said Garcia.
As he was being led away, Anguiano faced FOX 5's camera and said he was the victim.
“I’m the victim here,” said Anguiano.
Deputy District Attorney Ted Fiorito said surveillance video shows a different story.
“Simply put - the attack was vicious, brutal and on a defenseless woman on the ground,” said Fiorito. “Acts of this nature are completely against the law and should not be tolerated in any shape way or form.”
The charges Anguiano is facing stem from surveillance video of the Lodge Motel parking lot on Broadway in Chula Vista.
Prosecutors said Anguiano and his girlfriend were seen getting out of a car following an argument on August 6. Anguiano rushes to the passenger side, where he kicks his girlfriend twice -- knocking her to the ground, then in the head, a lawyer said. She appears to stop moving. A minute later, he struggles to load the unconscious victim into the car before getting back behind the wheel and taking off.
Hotel staff notified police after watching the altercation. Prosecutors say Chula Vista officers went to Anguiano’s home just four miles from the motel, found the victim unconscious and bleeding in the suspect’s car.
“All three counts could be felonies, can be strike offenses depending on the allegations that are attached to it and the maximum exposure in this case I believe is 14 years in state prison,” said Fiorito.
Chula Vista police said this is not the first time Anguiano has been in contact with police related to domestic violence.
Anguiano’s bail related to the surveillance video attack was raised from $180,000 to $200,000. He was given no bail status for violating terms of a felony probation in another case.
Anguiano’s family would not talk to FOX 5. His attorney Alan Spears said he would fight the no bail status.
Anguiano's next court hearing will be at the Chula Vista courthouse on August 25.
