Former Arlington High football standout Jay Davern was sentenced to eight years in prison Tuesday on charges of possession of child pornography in Seguin, Tex.




A former Arlington High School and TCU football standout was sentenced to eight years in prison on a charge of possession of child pornography.

Jason Howard (Jay) Davern, 42, of Seguin plead guilty on Tuesday to one count of possession of child pornography in the Guadalupe County Justice Center as part of a plea agreement. He was arrested by Texas Rangers on April 4 after an investigation into the charge.

The terms of the plea bargain include serving an eight-year sentence in the Texas Department of Criminal Justice system, with 163 days’ credit, a $1,500 fine plus court costs, and registering as a sex offender for life.

“I think this is a good outcome for all involved,” 25th Judicial District Attorney Heather McMinn said. “(William) ‘Bill’ Squires (III) did an excellent job prosecuting this case.”

Davern’s attorney, James Reeves, said the plea agreement was “a no-win situation for anybody,” but declined further comment, according to the Seguin Gazette.

The investigation was brought on by the Texas Rangers after a witness reported seeing suspected images of child pornography on Davern’s cell phone.

“During the examination, multiple images were found in the memory of the iPhone, which depicted juvenile victims engaging in sexual conduct, including sexual intercourse,” Texas Ranger Joey Evans wrote in his arrest affidavit.

With the help of the National Center for Missing and Exploited children, investigators were able to identify one of the victims depicted in the images.

Davern -- who was serving as an assistant football coach at Texas Lutheran University in Seguin before being fired in April after his arrest -- was a three-time All-District linebacker at Arlington High from 1990-92. In 1992, he earned All-State and All-America honors for the Colts before beginning his collegiate career at TCU in 1993.

While at TCU, Davern was indicted on an aggravated assault charge, along with three teammates, and placed on probation. He was later dismissed from the team by then-head coach Pat Sullivan in 1997 after he was arrested and charged with assault by threat and public intoxication.

Davern finished his collegiate playing career at Stephen F. Austin in 1997, returning to the school as an assistant coach before moving on to Oklahoma Panhandle State University and then Texas Lutheran.

I posted this because I knew this guy apparently. We went to high school together and also apparently played basketball on the same church basketball team. Its just shocking when you see someone you knew in some way do something horrific and go to prison.

I always wonder if it is allowed to claim that those depicted are of age and force the prosecution is find them.
