BOYTON BEACH, Fla. — On Wednesday night, a sheriff’s deputy responded to a local hospital in reference to a sexual battery case.

Hospital officials informed the deputy that the underage girl was pregnant.

The child told the deputy that Elvin Benitez-Lopez, 38, had been sexually assaulting her since she was 9 years old.

Benitez-Lopez told investigators that sometime after Halloween he had "a moment of weakness" with the child, but that it only happened once.

Benitez-Lopez is charged with sexual battery and impregnation of a child.
