A story about a black waitress being stiffed on a tip by a white customer who wrote that he “don’t tip black people” on the check is a hoax, according to the customer’s lawyer, who has documentary evidence to disprove the story.

Last month, multiple progressive news outlets such as the Huffington Post and Raw Story championed the story about Virginia waitress Kelly Carter at Anita’s New Mexico Style Cafe in Ashburn, Virginia. She said she received a racist note on a receipt that said “Great service, don’t tip black people.”

Carter also received exposure from the NAACP and the Virginia attorney general, and has received more than $3,6000 in well-intended donations to make up handily for the denied tip, the Daily Wire reports.

The lawyer for the “racist” customer, however, is accusing the waitress or someone close to her of fabricating the note. According to the lawyer, Daniel Hebda, the customer did in fact tip the waitress one penny for what he alleges was poor service – but says race was not a factor. The customer maintains that he actually left a note saying “terrible service.”

Hebda added that his client’s name was forged and the racist note the waitress showed everyone was on a new copy of the receipt. He is demanding that the restaurant “set the story straight and find out who is responsible.”

“Our client did not nor would he ever write anything about refusing to tip African Americans because of their race,” the lawyer said. “Our client has no ill feelings towards African Americans. Our client did not leave a $0.00 tip. Our client tipped $0.01 out of his own conviction against tipping well for poor service.”

This isn’t all: according to the Daily Caller, the receipt posted online shows that it was printed hours after the cafe was closed. It also bears markings that show that it was a “reprint of an original receipt.”

Despite doubtful evidence of the story, Carter received over $3,600 in donations after a local resident Brandon Ellis started a fundraiser for her. The restaurant owner, Tommy Tellez, claims the customers started pouring into the restaurant and “dropping off cash”.

The owner said last month of the racist note: “I was appalled, though it’s kind of in line with the political landscape.”

Despite the considerable evidence that the note was fabricated, the NAACP is “standing behind Carter,” WTOP reports. “It’s sad any way it goes,” said Philip Thompson, president of the NAACP Loudon chapter.
