ROCKVILLE, MD. (WUSA9) - Two male students are being charged with raping a female student inside of a bathroom stall at Rockville High School Thursday morning, Montgomery County police said.

Police said the victim was approached by the two suspects in a school hallway Thursday at about 9 a.m. One of the suspects then asked the victim to engage in sex. She refused, according to police. The suspect asked her again and then forced her into a boy's bathroom stall at school. Both of the suspects then raped the victim inside the stall, authorities said.

Jose O. Montano, 17 and Henry E. Sanchez, 18 of Aspen Hill were both charged with the rape of the female Rockville High School student. They are both being charged with first-degree rape and two counts of first-degree sexual offense.

Montano and Sanchez are in the 9th grade at Rockville High School.

A judge said they were dangerous and flight risks due to the fact they have only been in this country for a couple of months. Montano came to the U.S. from El Salvador. Sanchez came here from Guatemala. The judge said Sanchez had an "alien removal case" pending.

He ordered both of them held with no bond until their next court hearing. Montano will have a preliminary hearing on March 31, and Sanchez will have his on April 14.

Police have charged Montano, who is a juvenile, as an adult due to the seriousness of the crime.

The school released the following letter:


Dear Parents and Guardians:

I am writing to inform you about a serious incident that occurred at our school yesterday, March 16, 2017, and share with you how it is being addressed.

It was reported to administration that a student was sexually assaulted by two students in a restroom. We immediately contacted the Montgomery County Police Department. The police conducted an investigation and subsequently executed arrests on school property of the alleged assailants. I am unable to share further details at this time as this is an ongoing police investigation.

Ensuring a safe, secure and welcoming learning environment for all of our students is our top priority. Our staff remains vigilant in the monitoring of our school each and every day. Please remind your child that if they believe they are a victim of an assault or see something inappropriate, they should immediately tell a staff member.

New, brutal details emerged Monday in the alleged rape of a 14-year-old girl at a Maryland high school by two male students, at least one of whom was in the country illegally.

The unidentified student at Rockville High School in Rockville, Md. was violently raped, sodomized and made to perform oral sex in a campus bathroom stall by the two males, according to court records.

Jose O. Montano, 17, from El Salvador, and Henry E. Sanchez-Milian, 18, from Guatemala, were charged with first-degree rape and two counts of first-degree sexual offense after they allegedly attacked the girl at 9 a.m. last Thursday.

“The victim was walking in a school hallway when she met two male students, identified as Montano and Sanchez. Montano asked the victim to walk with him and Sanchez. Montano asked the victim to engage in sexual intercourse. She refused,” Montgomery County Police said in a statement.

“Montano asked the victim again and then forced her into a boy’s bathroom and then into a stall. Montano and Sanchez both raped the victim inside the bathroom stall.”

Court records describe the merciless and brutal assault by both Montano and Sanchez, who allegedly raped the young girl multiple times, vaginally, orally and sodomized her, as they spoke to each other in Spanish. Blood and male fluids were recovered from the scene by a forensic expert, court records show.

The victim knew just one of her alleged attackers, court record show.

Detectives from the Montgomery County Police Department Special Victims Investigations Division arrested Montano and Sanchez-Milian after school officials reported the incident.

According to U.S. Department of Homeland Security databases, a Border Patrol agent stopped Sanchez-Milian in August 2016 in Rio Valley Grande, Texas, and determined he’d entered the country illegally from Mexico.

Sanchez-Milian was ordered to appear before an immigration judge, but the hearing had not yet been scheduled.

He has has no previous encounters with U.S. Immigration and Customs Enforcement (ICE), a spokesman from the agency said.

ICE has since lodged an immigration detainer against Sanchez-Milian. The agency places detainers on individuals arrested on local criminal charges and who are suspected of being deportable, so that ICE can take custody of those individuals when they are released from local custody.

No information was released on 17-year-old Montano, other than his name, because of privacy restrictions related to him being a minor, an ICE spokesman confirmed.

However, The Washington Post reported Montano is a citizen of Guatemala.

All of the students are in the ninth grade, according to Fox 5 DC.

The station reported the judge who oversaw the alleged attackers’ bond hearing refused to release them on bail, because both students are “dangerous and flight risks.”

Montgomery County State’s Attorney’s Office spokesman Ramon Korionoff told NBC News, “These are very serious allegations carrying a life sentence. The potential of life in prison would be available as we prosecute these individuals.” Both Montano and Sanchez will be tried as adults.

The incident is horrifying, devastating for the young girl, and “disturbing on so many levels,” said Jessica Vaughan, the director of policy studies for the Washington, D.C. based Center for Immigration Studies.

She said the Obama administration, and its “disastrous handling” of the surge of illegal aliens arriving from Central America, is partially to blame, noting at least one, and possibly both of the youths were part of that surge.

“The surge of Central American kids has become a significant problem in many of the school districts where they are allowed to resettle,” Vaughan said.

Montgomery County has one of the “more notorious sanctuary policies”, Vaughan said, and the police deliberately do not cooperate with ICE.

“The result is that many gang members and other thugs and miscreants are allowed to remain in the county in defiance of immigration laws and causing problems like this,” Vaughan said, noting that just this week the city of Rockville was considering adopting its own sanctuary policy.

“Montgomery, like others that have absorbed a large number of the Central American youths, has experienced a noticeable uptick in violence that has been attributed to gangs like MS-13, and this has been especially acute in the high schools,” Vaughan said. “This is one of the worst case scenarios that was bound to happen, and it’s not an isolated case.”

A spokeswoman for the Montgomery County Public Schools wrote a letter to parents to inform them of the incident. She said ensuring a safe, secure and welcoming learning environment for all of their students is a “top priority.”

The rape of a 14-year-old girl last week in a boys’ bathroom of a Maryland high school, for which two immigrants have been charged, has fueled opposition to officials making the state a sanctuary for illegal immigrants.

One suspect in last Thursday’s attack is 17; the other is 18. Both were enrolled as freshman because of their weak English language skills. The two suspects, who were enrolled in Rockville’s Montgomery High School, are from Central America.

Four days after the rape, Maryland’s House of Delegates passed legislation to join states like California in becoming a “sanctuary state,” affording illegal criminal aliens additional protections and making it more difficult to deport them or ask about immigration status.

That action has infuriated Maryland officials.

“I am outraged by the brutal and violent rape of a 14-year-old girl in a Rockville public school,” Republican Gov. Larry Hogan said in a statement Tuesday. “The state of Maryland is calling on Montgomery County to immediately and fully cooperate with all federal authorities during the investigation of this heinous crime. The public has a right to know how something this tragic and unacceptable was allowed to transpire in a public school.”

The legislation that passed Monday will make Maryland a sanctuary for illegal alien criminals, further endanger its citizens and interfere with state and local law enforcement’s ability to cooperate with federal law enforcement, the governor said.

To no one’s surprise the attack has triggered widespread revulsion outside of Maryland.

"The reason the president has made it such a priority to crack down on illegal immigration is because of cases like this," White House spokesman Sean Spicer said Tuesday.

Montgomery County, where the alleged rape took place, is on a list released this week by U.S. Immigration, Customs and Enforcement (ICE) of “Jurisdictions that have enacted policies which limit cooperation with ICE.”

“When law enforcement agencies fail to honor immigration detainers and release serious criminal offenders, it undermines ICE’s ability to protect the public safety and carry out its mission,” said Acting ICE Director Thomas Homan.

One suspect, Henry E. Sanchez, 18, of Guatemala had been stopped by a Border Patrol agent in August 2016 in Rio Valley Grande, Texas, when he entered the country illegally from Mexico. Sanchez was ordered to appear before an immigration judge, but the hearing had not yet been scheduled.

It was not immediately clear if the other suspect, Jose O. Montano, 17, from El Salvador, was in the county illegally but county executive Ike Leggett told local press both had outstanding ICE orders.

Both were charged with first-degree rape and two counts of first-degree sexual offense. Charging documents allege that the pair dragged their female classmate into a boy’s bathroom last Thursday at 9 a.m., where they allegedly raped and sodomized her and forced her to perform oral sex.

Detectives from the Montgomery County Police Department Special Victims Investigations Division arrested Montano and Sanchez after school officials reported the incident. A forensic team recovered blood and male fluids from the bathroom, court records show.

ICE has since lodged an immigration detainer against Sanchez, so ICE can take custody of him when he is released, but it is unclear whether local law enforcement will comply.

ICE did not release information on Montano.

Both Montano and Sanchez will be tried as adults and could receive a life sentence. The judge who oversaw their bond hearing refused to release them on bail, because the students are “dangerous and flight risks.”

“There are pockets of aliens who move to sanctuary cities because they know they will be treated differently there,” said Claude Arnold, a former U.S. Immigration and Customs Enforcement special agent in charge of Homeland Security Investigations.

“Most sanctuary cities limit the way in which local law enforcement can cooperate with ICE, or order them not to cooperate at all. So in a case like this, local law enforcement might not be able to assist ICE, adding insult to injury,” Arnold said.

Officials in Montgomery County have been pushing to make the area a sanctuary for immigrants.

Last month, Rockville City Council Member Julie Palakovich Carr, a Democrat, introduced an ordinance to make Rockville a sanctuary city.

Montgomery County Executive Ike Leggett, a Democrat, in backing the proposal, said, "Understanding, tolerance, and respect are hallmarks of the Montgomery County way. Social justice for all is what we strive to achieve ..."

Jessica Vaughan, director of policy studies for the Washington, D.C.-based Center for Immigration Studies, said the county is already uncooperative with ICE when it comes to illegal immigrants like Sanchez.

“Montgomery County is not the worst, but it’s pretty bad,” said Vaughan. “When Northern Virginia cracked down around 2005 from 2011, many illegals moved to Montgomery County, where they knew they would be treated more leniently.”

While I broadly agree that immigration from 2nd and 3rd world countries has gone rampant, and needs better vetting processes, you are basing an assumption of all immigrants on the basis of one incident. This article needs firm data to prove its assertions.

Fox News' Bill O'Reilly slammed the mainstream media on Wednesday's "The O'Reilly Factor" for ignoring the case of two immigrant teens, at least one of whom is in the U.S. illegally, accused of raping a Maryland high school student.

"ABC, NBC, CBS did not cover it on their nightly news broadcasts," O'Reilly said in his "Talking Points Memo." "CNN did not cover the Maryland story in primetime last night. Ditto MSNBC. That is beyond anything I have ever seen in my 40 years-plus of journalism."

"We all know why," O'Reilly said. "Illegal immigration is a political issue." The host went on to accuse the media of "allowing the sanctuary [city] movement to pretty much run wild" by opposing President Donald Trump's hardline immigration policies.

O'Reilly warned that "many Americans have had enough of illegal immigration," saying that "the federal government has lost control over the immigration process, and ... many states and cities will not obey federal law, creating anarchy."

"[There] comes a time when citizens of any country have to demand justice, have to demand protection, demand the law be respected," O'Reilly said. "We have not, have not, come to that time yet in America."

Defense attorneys for one of the illegal immigrants accused of raping a 14-year-old girl in a high school bathroom in Rockville, Md., have claimed that the accuser agreed to have sex with the defendant and texted him "explicitly compromising" images of herself.

In a motion for bond review filed Monday, attorney David Wooten said the girl engaged in a text conversation with 17-year-old Jose Montano the day before the alleged assault. During that conversation, Wooten claimed the girl "acknowledged that she had already engaged in sexual activity with [Montano] previously, and asked if he liked what she had done."

The filing went on to say that the girl agreed to have sex with Montano the following day during gym class. Wooten argued that the new evidence showed that Montano "appears to be actually innocent, and should be released forthwith."

Fox News has not seen the texts.

Montano and 18-year-old Henry Sanchez, both Guatemalan nationals, were arrested March 17 charged with first-degree rape and two counts of first-degree sexual offense. Prosecutors said the two raped the girl at Rockville High School on March 16. Montano was charged as an adult.

Adolfo Sanchez-Reyes, the 43-year-old father of Henry Sanchez, was arrested Friday after a review found that he, too, was in the United States illegally, a spokeswoman for U.S. Immigration and Customs Enforcement confirmed on Monday.

Sanchez-Reyes was being held in the Howard County Detention Center and was ordered to appear in immigration court, the ICE spokeswoman added.

The girl was walking in a hallway when one of the suspects asked her to have sex and she refused, police said. They added that Montano forced her into a boy's bathroom stall before they raped her.

Federal law requires public schools to admit students even if they are in the country illegally.

"As a mother of two daughters and grandmother of four young girls, my heart aches for the young woman and her family at the center of these terrible circumstances," Education Secretary Betsy DeVos said last week. "We all have a common responsibility to ensure every student has access to a safe and nurturing learning environment."

Please name a developed nation where you can enter the country without government authorization or any authority to be there and, when caught, the government's position is "you're a crafty one, you got us good, it's okay, you can stay". It simply doesn't exist.
