AUSTIN, Texas (KEYE) - A man is facing charges after police say he assaulted a store clerk in downtown Austin before stealing a taco.
On Sunday morning, police responded to a robbery call from the Royal Blue Grocery at 609 Congress Ave.
The clerk told officers a white male with curly, blond hair wearing a striped polo shirt, brown shorts, and a brown bandage around his wrist had entered the store and grabbed one taco.
According to an affidavit, when the clerk said, "Is that it? That'll be $3.25," the man reached across the counter and grabbed her left breast.
The victim then grabbed the suspect's arm and yelled, "What the f---, man?" The suspect wiggled away from her grip and ran out of the door with the taco.
Court documents say the victim gave chase briefly before going back inside the store to compose herself. When she went outside for a cigarette, she spotted the suspect at the intersection of Seventh Street and Congress Avenue. She walked toward the suspect and took a photo of him before he ran off behind the Stephen F. Austin hotel.
When police arrived, the victim showed officers the photograph. Police left to search the area when they were immediately flagged down by valets who pointed toward the alley behind the Intercontinental Hotel.
While the officers were traveling north in the alley, they spotted the suspect -- later identified as 37-year-old Nicholas McPherson -- walking on Eighth Street.
The affidavit says when he saw the officers, McPherson attempted to run away. He was apprehended and transported back to the Royal Blue Grocery, where he was positively identified as the suspect by the victim's photograph.
McPherson is charged with robbery by assault, a second-degree felony.
