A man started smashing up a cafe because the manager was ‘ruining his chilled-out vibe’.

Zak Rziki, 23, had been taking advantage of the free wi-fi to watch dance music videos on his mobile phone at the Cosy Club in Victoria Street, Derbyshire, shortly after 9am on June 14.

While he was watching it, he was heard ‘screaming and making lots of noise’ and so the manager asked him to leave.

This prompted the 23-year-old to smash a lamp, pull records from their sleeves and pour two bottle of Lucozade all over the floor.

He also went outside and picked up a metal bucket ashtray and emptied it out on the ground inside the Cosy Club.

During his arrest, he was found to be carrying cocaine and then, in a separate incident, he attacked a man outside a Derby restaurant after his approaches to a woman ‘went unwarranted’.

In a third offence, Rziki stole alcohol from Marks and Spencer at the Intu centre.

Jailing him for nine weeks magistrate David Loydall said: ‘Clearly you live your life as someone whose own needs take priority. You seem to hold other people in contempt.

‘You carried out an unprovoked and sustained assault on a man in public and the criminal damage seems to have been some kind of revenge attack.

‘Because you could not get your own way you decided to smash the place up.

‘Your theft was arrogant and conceited and we have no other option than to send you to custody.’

Peter Bettany, prosecuting at Southern Derbyshire Magistrates’ Court, said Rziki was in the downstairs entrance of the cafe and the manager was upstairs.

Mr Bettany said: ‘She heard a noise of some volume like someone was screaming and enjoying themselves.

‘She went downstairs, saw the defendant and asked him to leave.

‘He swore at her grabbed a lamp and smashed the bulb and began pulling records from their sleeves.

‘He went outside, picked up the cigarette bucket and emptied the contents on the floor inside. He also poured two bottles of Lucozade on the floor.’

Mr Bettany said the police arrived, arrested Rziki and when they took him into custody at St Mary’s Wharf police station, they found a wrap of cocaine on him.

He said: ‘In his interview he said he was using the free wi-fi at the CosyClub to listen to dance music videos.

‘He said he felt the manager was disrespectful to him and told officers she had ‘ruined his chilled-out vibe’.”

Mr Bettany said the assault on the man took place outside Turtle Bay in The Wardwick, at around 2.30am on August 19.

He said: ‘The defendant made unwarranted advances towards a woman who told him to go away. He responded by punching a man who was with her. He punched him four of five times.’

And the theft from Marks and Spencer happened on June 19 when Rziki stole £32 of items ‘because he had no money or food’.

Rziki pleaded guilty to assault, criminal damage and theft.

Kelly Shooter, mitigating, said her client was about to start night shift agency work at a Boots warehouse in Burton.

She said: ‘He denies his advances towards the female were unwarranted and tells me he was acting in self-defence.

‘In terms of the criminal damage he says he was frustrated at the way he was being spoken to.’
