Some of the most popular ballot-marking machines, made by Election Systems & Software and Dominion Voting Systems, register votes in bar codes that the human eye cannot decipher,” according to a February report by Associated Press.
But according to researchers, that’s a problem, as “voters could end up with printouts that accurately spell out the names of the candidates they picked, but, because of a hack, the bar codes do not reflect those choices.”
“Because the bar codes are what’s tabulated, voters would never know that their ballots benefited another candidate,” the report adds.
State and local officials had reportedly rushed to replace old voting systems with the new software ahead of the 2020 presidential election out of fear of “unreliable electronic voting machines” in the wake of so-called “Russia’s interference in the 2016 U.S. presidential race.”

The report continued:
Officials tell voters to verify their selections on a paper ballot before feeding it into an optical scanner. But the scanner doesn’t record the text that voters see; rather, it reads an unencrypted quick response, or QR, barcode that is indecipherable to the human eye. Either by tampering with individual voting machines or by infiltrating the state’s central elections server, hackers could systematically alter the barcodes to change votes.
Such a manipulation could not be detected without an audit after the election.
The new voting system “presents serious security vulnerability and operational issues” caused by “fundamental deficits and exposure,” U.S. District Judge Amy Totenberg wrote in a recent order, in which she criticized state officials for not taking the problems more seriously.
“These risks,” Totenberg wrote, “are neither hypothetical nor remote under the current circumstances.”

A new report points out that an executive branch agency called the Wisconsin Election Commission allowed local county election clerks to “fix” ballots by filling in missing addresses for witnesses, and that might have violated a Wisconsin law requiring ballots to have a witness address to be validated.

Wisconsin Statute 6.87(6d) states unequivocally, “If a certificate is missing the address of a witness, the ballot may not be counted.”

But in August, the Wisconsin Elections Commission issued a directive stating that a clerk could fill in the address of the voter:

To make sure your ballot is counted, double check the following before you return it: Your voter information: this section is usually completed by your clerk and includes the date of the election, the county and municipality in which you are registered, your name, the address where you are registered, city, and zip code. Voter Signature: you (or your assistant) must sign in the Certification of Voter section. Witness Signature and Address: your witness must sign and provide their full address, (street number, street name, city) in the Certification of Witness section. Make sure your ballot is in your envelope and make sure the envelope is sealed properly.

If any of the required information above is missing, your ballot will not be counted.

In October, the Wisconsin Elections Commission issued a directive to the state’s county clerks that seemed to allow them to fix incomplete (or “spoiled”) ballots missing witness signatures, writing, “Please note that the clerk should attempt to resolve any missing witness address information prior to Election Day if possible and this can be done through reliable information (personal knowledge, voter registration information, through a phone call with the voter or witness). The witness does not need to appear to add a missing address.”

Derek Muller, a professor of law at the Iowa School of Law, told Just The News, “This is a complication thing about elections like this. I’ve seen it in a lot of jurisdictions, what might be sort of a technical violation of the statute, in this case encouragement to county clerks about how to use their judgment on whether or not to cure a ballot.”

Retired Wisconsin Supreme Court Justice Michael Gableman told WISN, “The statute is very, very clear. If an absentee ballot does not have a witness address on it, it’s not valid. That ballot is not valid.”

“In defiance of and direct contradiction to the statute, the Wisconsin Elections Commission gave guidance — that is, cover —to all 72 county clerks and turned the statute on his head,” said Gableman. “They said, ‘Gee, we know the law says an absentee ballot without the witness address is not valid, but county clerk, you have a duty to go ahead and look up on your own the witness’ address if there’s no address on the absentee ballot.’”

In sum, the plaintiffs have failed to prove that specific acts of fraud were performed by persons acting under color of state law, or that the irregularities in the voting, if eliminated from the final tally, would have changed the result.

Let’s summarize what we’ve learned:

The Federal Courts do have jurisdiction to resolve claims of state and city ballot fraud that causes ballot dilution, even in Presidential elections.

The Federal Courts can order a new election if necessary to address fraud, even in Presidential elections

The Trump campaign will need to prove (a) specific acts of misconduct (b) involving willful or knowing ballot fraud (c) by state officials or private persons acting with state officials (d) that changed the outcome of the election.

The Trump campaign can use expert testimony and statistical evidence to prove its case, but it needs some direct evidence too. (Remember that in a court of law, eyewitness testimony is considered direct evidence.)

Caveat: It’s important to note that we’ve done a deep dive into just a single Federal District Court case from 1976. A NY District Court ruling isn’t binding on other District Courts in other states, and could be ignored or overruled by SCOTUS.
