    The Constitutional Reckoning of State Lockdown Orders

    On October 3rd NPR reported that the Michigan Supreme Court struck down Governor Gretchen Whitmer’s state of emergency and the powers it granted. NPR writes

    In a 4-3 majority opinion, the state’s high court said she did not have that authority. “We conclude that the Governor lacked the authority to declare a ‘state of emergency’ or a ‘state of disaster’ under the EMA after April 30, 2020, on the basis of the COVID-19 pandemic. Furthermore, we conclude that the EPGA is in violation of the Constitution of our state because it purports to delegate to the executive branch the legislative powers of state government– including its plenary police powers– and to allow the exercise of such powers indefinitely,” wrote Justice Stephen J. Markman on behalf of the majority.

    Governor Whitmer has been one of the more heavy-handed executive figures during the pandemic. One of her policies went as far as to ban the selling of gardening supplies in stores that were still permitted to stay open.

    More importantly, however, this court ruling was not the first of its kind but the third in a series of legal victories against lockdown orders. The first was a Wisconsin Supreme Court ruling that declared parts of Governor Tony Evers’ stay at home order unconstitutional and the second was by a federal court that struck down Governor Tom Wolf’s policies in Pennsylvania.

    There is no doubt that the governors across the country have gone off the constitutional deep end in response to Covid-19, exercising powers that are not only unprecedented but unproven. These cases, notably in Michigan and Wisconsin, all share some important legal themes that may suggest the beginning of a constitutional reckoning for governors across America.

    Obvious Another vindication of Sweden

    Sweden, which refused to enforce a full lockdown, is constantly confounding its critics. Gloomy predictions of tens of thousands of deaths and overwhelmed hospitals due to Covid failed to materialise. In recent weeks, Sweden has not experienced anything close to the rise in cases and hospitalisations that have befallen Britain, France and Spain. And now it’s clear the Swedish approach is also paying dividends economically.

    A new forecast from Danske Bank expects Sweden to experience a much shallower recession than the major European economies and the US. It projects a fall in Swedish GDP of 3.3 per cent this year, compared to 4.3 per cent for the US, 5.8 per cent for the UK and a massive 8.3 per cent for the Eurozone. It also predicts higher growth in the Swedish economy next year compared to other Scandinavian countries.

    This news makes difficult reading for the Sweden bashers, who argued that its less restrictive approach would prove just as economically damaging as full-on lockdown.

    Back in July, an economist in the New York Times – a paper that has labelled Sweden a ‘pariah state’ over Covid – blasted Sweden’s approach as ‘a self-inflicted wound’ from which it had made ‘no economic gains’. ‘They literally gained nothing’, he gloated.

    This analysis has not aged well. Sweden’s economy shrank at a lower rate between April and June than other countries, many of which adopted harsher Covid measures. And in August, it even achieved a budget surplus – something that is difficult in normal times, let alone during a global pandemic.

    Sweden has managed to safeguard civil liberties and protect its economy more effectively than others, all while keeping Covid at manageable levels. It’s high time we took this lesson on board.

    Floriduh Student quarantined due to menstrual cycle

    FORT MYERS, Fla. — A Fort Myers parent says there is such thing as overly cautious when it comes to COVID-19 safety.

    Lexington Middle School told Sheila Gayle’s eighth grade daughter to quarantine for 10 days because of what they thought were COVID-19 symptoms. But, mom says it’s just “that time of the month.”

    Her daughter went back to school today. But not before taking a trip to see her doctor. after she reported feeling tired…the district required her to either quarantine until October 23rd or show proof that it wasn’t COVID-19.

    So, instead of dropping off her daughter at school Tuesday morning, Gayle had to visit to Physicians’ Primary Care for a doctor’s note saying her daughter’s menstrual cycle caused the fatigue.

    “This what it’s come down to, so every month I have to come when she’s on her cycle? It’s just ridiculous at this point,” she said.

    Gayle says Monday afternoon her daughter told the school nurse she had just started her cycle and felt tired. No fever, no body aches, just tired.

    “Just to have fatigue, because you’re tired? That’s unacceptable,” said Gayle.

    The nurse gave the student a form, indicating her fatigue could be related to COVID-19.

    A spokesperson for the School District of Lee County referred Fox 4 to their website, pointing out students can return to school sooner if a doctor proves symptoms are caused by something other than the coronavirus.

    Gayle said she had two options. Either quarantine her daughter, which would also mean quarantine her siblings enrolled in other Lee County schools, or take time off work and get the doctor’s note. She chose the latter, hoping she won’t have to go through this again next month.

    “I just feel like this whole system needs to be re-evaluated,” said Gayle.

    The district said as of now students are not required to quarantine if a sibling has COVID-19 related symptoms. Even though it may seem a bit extreme, a spokesperson for the district says they’d rather be safe than sorry.

    Sad ‘It’s Really Hard To Cope’: Youth Suicides Skyrocket Nearly 90% In Wisconsin County

    The number of people under age 24 who have killed themselves compared to last year rose nearly 90% in Dane County, Wisconsin, the state’s second most populous county.

    The number of young people in Dane County who have died by suicide rose from eight in all of 2019 to 15 in 2020 as of mid-September, according to the Wisconsin State Journal. The county’s five-year average for annual suicides among ages 24 and younger is 10.

    Suicide rates have spiked among other age groups as well, according to Hannah Flanagan, the director of emergency services for Journey Mental Health Center in Madison, Wisconsin.

    Flanagan pinpointed the socially isolating effects of COVID-19 lockdowns as a contributing factor in the troubling statistic. “When people are lonely, it’s really hard to cope,” she said. “The specificity about COVID social distancing and isolation that we’ve come across as contributing factors to the suicides are really new to us this year.” Crisis calls to the center, she said, are up 15% since the pandemic began.

    Dr. Katie Schmitt, medical director at UnityPoint Health-Meriter’s Child and Adolescent Psychiatric Hospital in Madison, Wisconsin, also noticed an increase in the number of children seeking mental health treatment, claiming July saw a 25% increase in the number of admissions.

    “The social isolation, the lack of success in virtual schooling, the lack of ability to connect with staff at school — not one kid comes here that doesn’t have that as current, significant stressors,” Schmitt said.

    Dr. Katy Cahill, a pediatrician in Madison, told the State Journal, “I can’t tell you the number of times I’ve heard parents say that they feel like their children have wilted. We definitely have seen an uptick in mental health concerns across all ages, which is really sad and concerning to us.”

    According to a CDC survey released in August, more than a quarter of those surveyed between the ages of 18-24 had “seriously considered” killing themselves during a 30-day period.

    Young people are not the only ones suffering from the mental anguish seemingly linked to the loneliness of interminable lockdown.

    As The Daily Wire reported:

    A group of longterm-care residents at a nursing home in Greeley, Colorado, protested outside their residence last week in opposition to lingering state lockdown restrictions that keep them from having physical contact with their loved ones.

    Approximately 20 residents, many in wheelchairs, gathered outside Fairacres Manor on Thursday, according to CBS4 Denver. Some of the handwritten signs they held read, “Prisoners in our own home” and “Give us freedom.”

    One resident’s sign stated simply that she would rather die from COVID-19 than loneliness.

    The Fairacres Resident Council organized the event, according to CBS4. Resident Council President Sharon Peterson told the outlet, “We used to be lucky here at Fairacres to show each other what we mean to one another and we cannot do that anymore. Fairacres follows the rules and, with that, we think they would keep us safe while being able to be with our families again.”

    “We did this because one thing we have to look forward to is a simple hug,” Peterson added. “It gives us meaning.”
