News Fired Ky. police officer indicted on criminal charges linked to Breonna Taylor shooting, but not her death

By Danielle Wallace | Fox News

One of three officers involved in the Louisville, Ky., drug operation that led to the police shooting death of Breonna Taylor in March 2020 was indicted Wednesday on criminal charges.

Officer Brett Hankison, whom the department fired in June, was indicted on three counts of wanton endangerment in the first degree, a Jefferson County grand jury announced Wednesday. Neither the grand jury nor the presiding judge elaborated on the charges.

A warrant has been issued for Hankison's arrest and a bond is set at $15,000 cash.

No charges were announced against the two other officers involved in the raid -- Myles Cosgrove and Sgt. Johnathan Mattingly, who was shot in the leg and underwent surgery after the police operation that resulted in Taylor's death.

The indictment was announced 194 days after Taylor, a 26-year-old Black emergency medical worker, was shot six times by the officers who entered her home using a no-knock warrant during a narcotics investigation on March 13.

An investigation found that the bullets fired by Hankison traveled into the neighboring apartment while three residents were home – a male, a pregnant female and a child, Attorney General Daniel Cameron said at a press conference after the grand jury's announcement. Hankinson was not charged in Taylor's death, but rather for endangering her neighbors' lives.

Hankinson faces up to five years on each of three counts if convicted, Cameron said.

"The decision before my office as the special prosecutor, in this case, was not to decide if the loss of Ms. Taylor's life was a tragedy. The answer to that is unequivocally 'yes,'" Cameron said. "I understand that Breonna Taylor's death is part of a national story, but the facts and evidence in this case are different than others...

“If we simply act on emotion or outrage, there is no justice," Cameron said. "Mob justice is not justice. Justice sought by violence is not justice. It just becomes revenge."

Based on interviews with neighbors, Cameron’s office determined that the officers announced themselves before busting down the door of the apartment occupied by Taylor and her boyfriend, Kenneth Walker. Cameron said Mattingly and Cosgrove were justified under Kentucky law in their use of force after being fired upon by Walker and his office will not pursue criminal charges against them.

“According to Kentucky law, the use of force by Mattingly and Cosgrove was justified to protect themselves. This justification bars us from pursuing criminal charges in Miss Breonna Taylor's death," Cameron said.

Walker was charged with the attempted murder of a police officer, but local prosecutors later dropped the charge. He told police he heard knocking but didn’t know who was coming into the home and fired in self-defense.

Cameron said FBI ballistics determined that the fatal shot that killed Taylor was fired by Cosgrove.

Immediately after the announcement, people were expressing frustration that the grand jury did not do more.

“Justice has NOT been served,” tweeted Linda Sarsour of Until Freedom, a group that has pushed for charges in the case. “Rise UP. All across this country. Everywhere. Rise up for #BreonnaTaylor.”

Attorney Ben Crump tweeted that the grand jury indicted Hankison with three counts of wanton endangerment in the first degree “for bullets that went into other apartments but NOTHING for the murder of Breonna Taylor. This is outrageous and offensive!”

The warrant used to search Taylor's home was connected to a suspect who did not live there, and no drugs were found inside. The use of no-knock warrants has since been banned by Louisville’s Metro Council.

Hankison was fired from the Louisville Metro Police Department on June 23. A termination letter sent to him by interim Louisville Police Chief Robert Schroeder said the White officer had violated procedures by showing “extreme indifference to the value of human life” when he “wantonly and blindly” shot 10 rounds of gunfire into Taylor’s apartment in March.

Hankison, Mattingly, Cosgrove, and the detective who sought the warrant, Joshua Jaynes, were placed on administrative reassignment after the shooting. On Sept. 15, the city of Louisville settled a lawsuit against the three officers brought by Taylor’s mother, Tamika Palmer, agreeing to pay her $12 million and enact police reforms.

Protesters in Louisville and across the country have demanded justice for Taylor and other Black people killed by police in recent months. The release in late May of a 911 call by Taylor’s boyfriend marked the beginning of days of protests in Louisville, fueled by her shooting and the violent death of George Floyd while in police custody in Minneapolis on May 25.

Several prominent African American celebrities including Oprah and Beyoncé have joined those urging that the officers be charged.

Louisville police officers shot amid Breonna Taylor protests; suspect in custody

By Michael Ruiz, Brie Stimson | Fox News

Two police officers were shot in Louisville, Ky., on Wednesday night as protesters flocked to the streets to rally against the death of Breonna Taylor, authorities said.

Shortly after a police news conference, reports emerged on social media that a third police officer may have been injured.

The two police victims confirmed by authorities were being treated at a hospital for non-life-threatening injuries, Interim Louisville Metro Police Department Chief Robert Schroeder said in a short news conference around 10 p.m. ET.

"One is alert and stable, the other officer is currently undergoing surgery and stable," Schroeder said, adding that one suspect was in custody. The suspect was not identified and potential charges were not available.

One officer was shot in the abdomen, below a bulletproof vest, while the other was shot in a thigh, sources told the Courier journal of Louisville.

Schroeder said the shootings happened at the intersection of First and Broadway. It was unclear whether the protests played a role in the shootings.

"I am very concerned about the safety of our officers," he told a reporter. "I think the safety of our officers and the community we serve is of utmost importance."

President Trump on Wednesday night tweeted he was "Praying for the two police officers that were shot tonight in Louisville, Kentucky. The Federal Government stands behind you and is ready to help. Spoke to @GovAndyBeshear and we are prepared to work together, immediately upon request!"

Louisville Mayor Greg Fischer tweeted late Wednesday, "Our hearts go out to the two @LMPD officers who were shot. Please pray for them and their families, & pray for our city, and all who are in pain today. For anyone who is still out, please go home tonight. Violence doesn't get us closer to a fair, just and equitable city."

Kentucky Gov. Andy Beshear also posted comments via video.

Democratic nominee Joe Biden also said he and his wife, Jill, are praying for the wounded officers and he condemned protest-related violence as "never..the answer."

A third officer reportedly suffered minor injuries but wasn't shot, a reporter with WGCL-TV in Atlanta reported. The station reported that two civilians also were shot.

Demonstrators turned out in droves hours after a grand jury handed down charges against one of three officers involved in the March raid inside Taylor's apartment -- with none of the charges directly involving Taylor's death.

The local branch of the FBI said on Twitter that its SWAT team responded to an officer shooting and was assisting in the investigation.

A grand jury earlier in the day indicted one of the three officers who took part in the botched drug operation in Taylor's apartment, targeting a man who did not live there and who was already in custody.

The charges against former LMPD Officer Brett Hankison were for recklessly firing stray bullets that found their way into a neighboring family’s home. He was fired in June.

Civil rights attorney Ben Crump called the charges “outrageous and offensive to Breonna Taylor’s memory.”

“It’s yet another example of no accountability for the genocide of persons of color by white police officers,” he said in a joint statement with co-counsels Sam Aguiar and Lonita Baker. “With all we know about Breonna Taylor’s killing, how could a fair and just system result in today’s decision?”

Protesters shouted slogans like “No justice, no peace” and criticized the charges in connection with Taylor’s death.

Photographs taken during the protests show tense confrontations between protesters and police after dark.

In one, police brandish firearms and clear out an intersection near where the officer was shot. In others, fires burn on the sidewalk.

TownHall reporter Julio Rosas shared video to Twitter that he said showed people trying to set fire to the courthouse’s boarded up windows.

Demonstrators were marching in other cities around the country, too, including New York City, Chicago, Atlanta and Washington, D.C.

Taylor was shot and killed in the crossfire when her boyfriend, Kenneth Walker, allegedly opened fire on police officers who entered her apartment March 13, according to Kentucky Attorney General Daniel Cameron. Walker has stated he believed the officers were intruders.

Louisville protesters grab signs, shields other supplies from U-Haul truck: video

By Fox News Staff | Fox News

Protesters in Louisville, Ky., grabbed signs, shields, water and other supplies from a U-Haul truck that pulled up near Breonna Taylor protests Wednesday, according to video and reports.

Some of the signs had anti-police slogans like “Abolish the police” “Abolition now” and “F12," acccording to video shot by a TownHall reporter.

After a Kentucky grand jury opted to indict only one of the three Louisville police officers Wednesday in the raid that led to Breonna Taylor's death earlier this year, protests erupted in the city and other around the country Wednesday night.

At least two police officers were shot in Louisville, police confirmed. Both officers suffered non-life-threatening injuries.

Update Breonna Taylor shooting: Bodycam footage apparently shows Louisville officers violating policies, report says

By Greg Norman | Fox News

Newly obtained video taken in the moments following the police operation that resulted in the death of Breonna Taylor apparently shows Louisville officers violating department policies, a report claims.

The footage -- captured by 45 different body cameras and included in a Louisville Metro Police Department investigative file -- shows the seven officers present for the operation not immediately being paired up with escort officers at the scene after Taylor was shot, according to VICE News.

Under department policy, any officers involved in use of force actions that result in death or serious physical injury should be assigned an escort officer who will “remain with [him or her] throughout the entire initial investigation” and keep them “isolated from all non-essential individuals” during that stretch.

“This is not how it’s supposed to work,” a former Louisville narcotics officer who reviewed parts of the footage told VICE News, mentioning how on-scene commanders should make sure that those officers involved are pulled aside.

The website, citing the bodycam videos, reports that four of the officers were seen roaming around in the immediate aftermath with their guns drawn.

Brett Hankison – who went on to become the only officer indicted by a grand jury in the incident – is seen entering Taylor’s apartment following the shooting and asking responding SWAT team members if they found a long gun, according to VICE News.

“I’d back out until they get PIU in here,” the website quoted SWAT Sgt. Brandon Hogan as telling Hankinson, referencing the department’s Public Integrity Unit, which probes officer-involved shootings. “This is a crime scene.”

Another officer who was present for the operation – Detective Mike Campbell – told investigators that he “went up and talked, checked, tried to make contact with all the apartments to make sure they were okay” after the SWAT team went through Taylor’s residence, VICE News reports.

Detective Myles Cosgrove – who is said to have discharged his weapon 16 times that night – was also reportedly seen not being separated from the other responding officers.

A report that the department sent to the attorney general’s office stated that “investigators later learned Detective Hankison deviated from standard LMPD practices for an officer involved in a critical incident and left the scene location without his assigned LMPD Peer Support escort,” according to VICE News.

Hankinson was fired by the department following the shooting.
