So it turns out my last employer was deducting the 401k funds from our checks, and then using an empty account to fund the 401k. So essentially he was able to remove the money form our checks and keep it. To make it worse the 401k provide3r kept letting it happen. So now my account is in default by 4k and they refuse to release the funds, and the other company is owned by a scammer who I doubt will bring the accounts current, so now I have to get a lawyer and report it to the Department of Labor

How much are you owed from that 401K? The lawyer might end up costing more than what you had put away in there unfortunately.

They owe my just over 30k, but I found out the entire pool for the company is almost a million. So nobody can get their funds until they make it current. Which it doesn't sound like they can/will. The owner is ripping off everyone he is in contact with its sounds like since about Sept, including stealing his fathers identity and taking out loans.
I'm hoping he goes to prison
I'm also hoping the insurance for the 401k is current, but at this point it probably isn't.

At the end of the day, my current company will cover it if it cant be recovered, but it still is shitty. And I'm sure I will be taxed on the new lump sum. What a POS this guy is though

I can't believe the medical shit I went through last year, and what I paid for it, didn't amount to jack shit. I slaughtered the catastrophic deductible last year.
