Rubio warns of Dem lawyers 'descending on Florida' to 'try and steal' key statewide races

Florida Republican Sen. Marco Rubio on Thursday charged that two Democrat-controlled counties in the state, in possible violation of election law, have been reporting a "slow drip" of tens of thousands of additional ballots favorable to several Democratic candidates for statewide office, including incumbent Sen. Bill Nelson.

Liberal lawyers, Rubio said in an extraordinary series of tweets that alleged incompetence if not outright complicity by Florida officials, are "descending on" the state in a calculated attempt to "change the results" and "try and steal" races for Senate and agriculture commissioner.

Rubio's explosive posts come as a recount now appears imminent in Florida's high-profile gubernatorial contest between Democrat Andrew Gillum and Republican Ron DeSantis, based on new vote totals -- even though Gillum has already conceded.

"Florida law requires counties report early voting & vote-by-mail within 30 minutes after polls close," Rubio wrote on Twitter. "43 hours after polls closed 2 Democrat strongholds #BrowardCounty & #PalmBeachCounty are still counting & refusing to disclose how many ballots they have left to count."

Florida statutes mandate that the "canvassing board shall report all early voting and all tabulated vote-by-mail results to the Department of State within 30 minutes after the polls close" and that "thereafter, the canvassing board shall report, with the exception of provisional ballot results, updated precinct election results to the department at least every 45 minutes until all results are completely reported."

The state code continues, "The supervisor of elections shall notify the department immediately of any circumstances that do not permit periodic updates as required."

Vote totals in several major races in the state are changing rapidly, on an irregular schedule and sometimes late into the evening. GOP Senate candidate Rick Scott, also Florida's governor, was ahead of Nelson by roughly one-fourth of one percentage point as of Thursday morning, according to The Tampa Bay Times. The paper also said the agriculture commissioner candidates were separated by only 0.06 points. That race flipped in favor of the Democratic candidate on Thursday afternoon.

Broward County reported that significantly more votes were received in the agriculture commissioner contest than the much higher-profile Senate election. An attorney for Nelson's campaign suggested a computer error might explain that anomaly.

In the closely watched gubernatorial race, DeSantis' held a narrow 0.52-percentage-point edge over Gillum as of Thursday morning, extremely close to the 0.5 percent threshold needed to trigger a machine recount. Gillum has conceded the race, although his decision is nonbinding.

But by Thursday afternoon, unofficial figures had DeSantis up by just 38,515 votes out of the more than 8 million cast -- a lead of just 0.47 percent, low enough to trigger a mandatory recount, according to The Tallahassee Democrat. No recount has yet been announced by Florida's secretary of state, and the first unofficial count is expected to be verified Saturday by Florida's secretary of state.

"On Tuesday night, the Gillum for Governor campaign operated with the best information available about the number of outstanding ballots left to count," Gillum's campaign said in a statement Thursday evening. "Since that time, it has become clear there are many more uncounted ballots than was originally reported. Our campaign, along with our attorney Barry Richard, is monitoring the situation closely and is ready for any outcome, including a state-mandated recount."

Without providing legally sufficient justification, Rubio said, Democrat-controlled Broward and Palm Beach counties on Wednesday afternoon continued to report new ballots, cutting into Scott's already-thin lead and flipping the state's agriculture commissioner race to Democrats. Provisional ballots cast by voters without proper identification or at the wrong location are factoring into the late results, and Florida officials have rejected campaigns' requests for the identity of those voters, citing federal and state law.

Palm Beach County Supervisor of Elections Susan Bucher told Fox News that Palm Beach is still counting about 2,000 mail-in ballots where voters circled or highlighted (by drawing an arrow pointing at the candidate’s name) their choice, instead of filling in the appropriate bubbles.

Under Florida law, the state elections department is allowed to determine voter intent. Bucher told Fox News that elections department staff is going through each of the 2,000 mail-in ballots, and where voter intent is determined, a worker is filling in a new ballot on behalf of the voter. Where voter intent cannot be determined, the ballot is sent to the canvassing board to undergo review.

Elections officials are also reviewing 1,500 military and overseas ballots which are still being counted. Florida law allows military servicemembers to mail or fax ballots in. A provisional vote report is due in Tallahassee on Saturday by noon.

"#Broward election supervisors ongoing violation of #Florida law requiring timely reporting isn’t just annoying incompetence," Rubio wrote. "It has opened the door for lawyers to come here & try to steal a seat in the U.S. Senate & Florida Cabinet."

Broward county election officials did not immediately return Fox News' request for comment.

Rubio added: "Now democrat lawyers are descending on #Florida. They have been very clear they aren’t here to make sure every vote is counted. - They are here to change the results of election; & - #Broward is where they plan to do it."

Under Florida law, if the margin in any race hits 0.25 percent or lower, a manual recount of any ballots set aside from the machine recount will be ordered -- reminiscent of the scene in the 2000 presidential election, when the country was gripped by images of poll workers counting votes deciphering hanging chads by hand.

The Supreme Court voted by a 7-2 majority that Florida's recount in that race violated the Equal Protection Clause of the Constitution because each country and precinct adopted varying standards for how it would conduct the recount. By a 5-4 vote, the Supreme Court ended the recount on other grounds.

Rubio made clear he has no confidence in the integrity of South Florida's election officials, suggesting a posssible GOP-led court challenge might be looming.

"A U.S. Senate seat & a statewide cabinet officer are now potentially in the hands of an elections supervisor with a history of incompetence & of blatant violations of state & federal laws," he wrote, linking to a Miami Herald article describing several scandals that have gripped Broward County’s Elections Department.

Earlier this year, a judge found that Broward Elections Supervisor Brenda Snipes had illegally destroyed ballots in a 2016 congressional contest, leading the governor's office to assign election monitors to supervise her.

“I think the problems are blown out of proportion,” Snipes said in October, in an interview with The Miami Herald. “Broward is nitpicked to the bone. Other places have the same problems, different problems. It’s just that they are not spotlighted like we are.”

Accusing Democrats of conducting a coordinated effort to "steal" elections in a campaign of possibly "rampant fraud," Republican Senate candidate Rick Scott filed explosive lawsuits late Thursday against the top election officials in two heavily Democratic counties, as they continue to report new votes and three major races in the state appear headed for recounts.

In their lawsuit against Broward County, Scott and the National Republican Senatorial Committeee (NRSC) allege that officials there are hiding critical information about the number of votes cast and counted. And in a parallel suit against Palm Beach County, Scott and the NRSC charge that the election supervisor there illegally used her own judgment to determine voter intent when reviewing damaged or incorrectly filled-out absentee ballots, while refusing to allow impartial witnesses to monitor the process.

"I will not stand idly by while unethical liberals try to steal an election," Scott, who is currently Florida's governor, said at a press conference outside the Governor's Mansion, as he slammed potential "rampant fraud" in the race.

Scott is running against longtime incumbent Democratic Sen. Bill Nelson. On Thursday, a Nelson spokesperson tersely dismissed Scott's effort: “The goal here is to see that all the votes in Florida are counted and counted accurately. Rick Scott’s action appears to be politically motivated and borne out of desperation.”

The bombshell litigation comes hours after Florida GOP Sen. Marco Rubio, in an extraordinary series of tweets that alleged incompetence if not outright complicity by Florida officials, charged that Democratic lawyers were "descending on" the state in a calculated attempt to "change the results" and "try and steal" several statewide races.

Also late Thursday, President Trump threw another wrench into the evening, announcing on Twitter that "Law Enforcement is looking into another big corruption scandal having to do with Election Fraud in #Broward and Palm Beach." He did not elaborate, but speaking to Fox News' "Hannity," Scott said he had directed a Florida law enforcement agency to probe the matter.

"Late Tuesday night, our win was projected to be around 57,000 votes," Scott told reporters. "By Wednesday morning, that lead dropped to 38,000. By Wednesday evening, it was around 30,000. This morning, it was around 21,000. Now, it is 15,000."

He continued: "On election night, Broward County said there were 634,000 votes cast. At 1 a.m. today, there were 695,700 ballots cast on election day. At 2:30 p.m. today, the number was up to 707,223 ballots cast on Election Day. And we just learned, that the number has increased to 712,840 ballots cast on Election Day. In Palm Beach County, there are 15,000 new votes found since election night.

"So, it has been over 48 hours since the polls closed and Broward and Palm Beach Counties are still finding and counting ballots – and the Supervisors – Brenda Snipes and Susan Bucher – cannot seem to say how many ballots still exist or where these ballots came from, or where they have been," Scott said.

A mandatory recount now appears imminent not only in Scott's race, but also in the agricultural commissioner contest and Florida's high-profile gubernatorial brawl between Democrat Andrew Gillum and Republican Ron DeSantis, based on new vote totals -- even though Gillum has already conceded. Florida law requires a machine recount when candidates are within 0.50 percentage points of each other.

Speaking to "Hannity" Thursday night, Scott said, "We don't know how many votes they're gonna come up with. But it appears they're going to try to come up with as many votes as it takes to win this election. ... We're gonna fight this, and we're gonna win."

Earlier in the evening, he was just as direct: "No ragtag group of liberal activists or lawyers from D.C. will be allowed to steal this election from the voters in the state of Florida," he said outside his residence.

Scott's first emergency complaint accuses Broward County Supervisor of Elections Brenda Snipes of being "unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed," and charges that the uncertainty "raises substantial concerns about the validity of the election process."

The NRSC specifically allege that Snipes is in violation of the Florida Constitution and the Florida Public Records Act. They demand an emergency hearing, as well as a court order requiring Snipes to turn over information about ballots in Broward County.

Scott's complaint against Palm Beach County Supervisor of Elections Susan Bucher, meanwhile, alleges first that officials there illegally refused to allow Republicans, or any witnesses, to monitor the county's handling of damaged absentee ballots.

"Even more alarmingly," Scott additionally claims, Bucher "failed to allow the Palm Beach County Canvassing Board" to determine, as required by law, which damaged or improperly filled-out absentee ballots were valid and how the voters of those ballots had intended to vote. Instead, Scott and the NRSC argue, Bucher and her staff simply used their own judgment when determining voters' intent.

The suit against Bucher demands an injunction requiring Bucher to make and compare duplicate copies of all damaged absentee ballots in the presence of Scott's representatives, and to allow the Palm Beach County Canvassing Board to determine voters' intent when counting those ballots.

Rubio, in his barrage of broadsides against Snipes earlier in the day, pointed to the "slow drip" of tens of thousands of additional ballots that were reported throughout the day Thursday, most of which were favorable to several Democratic candidates. Rubio said those late disclosures violated Florida election law, which necessitates that mail-in and early voting ballots be counted within 30 minutes of polls closing.

"Bay County was hit by a Cat 4 Hurricane just 4 weeks ago, yet managed to count votes & submit timely results," Rubio wrote. "Yet over 41 hours after polls closed #Broward elections office is still counting votes?"

Rubio and Scott both made it clear they have no confidence in Snipes' integrity.

Lawyers are descending on Florida as the state braces once again to become ground zero in a national election fight, and the epicenter appears to be Broward County where late-arriving ballots in Democratic strongholds are fueling accusations of political shenanigans.

Florida Republican Sen. Marco Rubio has highlighted a range of possible problems in the county—from suspected mystery truck deliveries of ballots to questions about abandoned ballot boxes and more—and has criticized local officials for their molasses-like process of counting ballots in the Senate race between Republican Rick Scott and incumbent Democratic Sen. Bill Nelson.

Scott, Florida’s outgoing Republican governor, warned of possibly “rampant fraud,” and filed lawsuits late Thursday against the top election officials in two heavily Democratic counties as they continue to report new votes.

“Under #Florida law, county must upload by 7 p.m. day BEFORE election ALL early votes canvassed & tabulated by end of early voting & report results within 30 minutes of polls close. 60 hours after that deadline only 1 of 67 counties is still counting early votes, #BrowardCounty,” Rubio tweeted Friday morning.

Minutes later, he added that early voting in Broward County had ended “108 hours ago,” and that county officials “won’t disclose how many ballots are left.”

“The incompetence & the violation of #Florida reporting requirements by #BrowardCounty elections dept could impact more than just the outcome. The last thing our already dangerously divided nation needs is an important election 1/2 our people believe was rigged by the other 1/2,” Rubio tweeted.

Rubio also shared a video, allegedly showing ballots being transported in private vehicles from polling places.

He also shared the account of a lone box labeled “Provisional Ballot Box” left at a county elementary school that served as a polling precinct.

In the Scott campaign’s lawsuit, joined by the National Republican Senatorial Committee (NRSC), they allege that officials in Broward County are hiding critical information about the number of votes cast and counted. A state judge on Friday sided with Florida Republican Rick Scott in ordering that Republicans be granted “immediate” access to requested information about ballots in Broward County, amid explosive lawsuits against the county’s top election official.

In their lawsuit against Broward, Scott – the Republican gubernatorial incumbent narrowly leading in the state's race for a U.S. Senate seat -- and the National Republican Senatorial Committee (NRSC) allege that officials there are hiding critical information about the number of votes cast and counted.

In an emergency court hearing on Friday afternoon, state Judge Carol-Lisa Phillips ruled there has “been a violation of the Florida constitution,” as well as the state’s public records act, by not turning over requested records.

Phillips ordered Broward County Supervisor of Elections Brenda Snipes to allow for the “immediate inspection” and “photocopying” of the requested records no later than 7 p.m. Friday.

It comes as Scott has warned of possibly “rampant fraud,” two heavily Democratic counties continue to report new votes, and three top races in the state appear headed for recounts. Fox News confirmed Friday that an unknown number of “bags” of uncounted early vote ballots have been found in Broward County. It is less than 100 ballots total, but officials did not give a precise number.

Scott's emergency complaint accused Snipes, the Broward County supervisor of elections, of being "unwilling to disclose records revealing how many electors voted, how many ballots have been canvassed, and how many ballots remain to be canvassed," and charges that the uncertainty "raises substantial concerns about the validity of the election process."

President Trump himself has gone after Snipes, telling reporters Friday, “She has had a horrible history … and all of a sudden they’re finding votes out of nowhere.”

And one conservative congressman in Florida has taken matters a step further, calling for Snipes’ removal.

“The outrageous ballot-counting issues in Broward County are un-American and unacceptable,” Rep. Matt Gaetz said in a statement. “I call on Governor Scott to immediately suspend Brenda Snipes, Supervisor of Elections for Broward County. She has failed to follow state transparency laws during this election, and has a long history of misconduct, including preemptively destroying ballots.

Scott, speaking with Fox News’ Dana Perino on “The Daily Briefing,” said Friday “there’s no transparency” to the vote count.

“You have to assume the worst here,” Scott said, vowing to press ahead in the courts. “We already won it once. We have to win it twice now in the courts.”

Referring to himself as the state’s senator-elect, he voiced disbelief at the sheer number of votes discovered in Broward County since election night: “How do you come up with 78,000 more votes in one county? … The Democrats are trying to steal this seat.”

“As soon as Democrats sent their best Election stealing lawyer, Marc Elias, to Broward County they miraculously started finding Democrat votes. Don’t worry, Florida - I am sending much better lawyers to expose the FRAUD!” Trump said

The establishment media is dismissing the election scandal in Florida as a conservative conspiracy theory, but the evidence indicates something strange is afoot.

Republican Governor Rick Scott beat incumbent Democratic Sen. Bill Nelson for the state’s open Senate seat, but days after the election, election supervisors in Broward and Palm Beach counties were still adding votes to the tally.

The supervisors refused to share where the additional ballots were coming from and how many were left to count, leading Republicans in the state to cry foul.

The media swiftly rebuked Republican concerns of potential fraud or misconduct as “conspiracy theories” cooked up to deny Democrats the election.

Will Sommer of The Daily Beast wrote, “Republican and internet conspiracy theorists are freaking out as new ballots threaten their Florida Senate win.”

“Republican” strategist and CNN contributor Ana Navarro similarly wrote on Twitter, “Some folks in Florida need to lay-off the Cuban coffee. Stop spreading conspiracy theories and let the process play-out.”

Vox alleged that Republicans are only upset with the process “because [Democrats are] counting all of the votes cast in the Florida Senate race.”

Despite the media’s dismissal, Republicans have already proved that election supervisors in the deep-blue counties of Broward and Palm Beach are acting improperly.

Scott filed two lawsuits on Thursday night alleging that Palm Beach County Elections Supervisor Susan Bucher and Broward County Elections Supervisor Brenda Snipes were breaking Florida election law.

A judge ruled in favor of Scott in both cases, ordering Bucher to submit “over-voted” and “under-voted” absentee ballots for public review, and ordering Snipes to hand over voter information.

Neither Bucher nor Snipes had complied with the court order by the 7 pm deadline Friday night.

Meanwhile, the Miami Herald reported late Friday night that Snipes had “accidentally” mixed bad provisional ballots with good ones, making it nearly impossible to determine which of those votes should be counted.



“There are at least 20 illegal votes mixed into an anonymous pile of 205 [provisional ballots], all sitting in a machine that counted them but did not add them to the final count,” the Herald explained.

“The ballots cannot be identified,” Snipes confirmed.

The Federalist’s Mollie Hemingway broke down the other ways in which the two counties had failed to follow Florida law — despite 65 out of 67 of Florida counties (including the ones devastated by hurricanes) doing it correctly.

Florida law also requires that vote-by-mail and absentee ballots are accounted for within 30 minutes of polls closing. While the other 65 counties in Florida had no problem following this state law, the supervisors of Broward County and Palm Beach County refused to follow that law.

Florida law also requires that the Department of State be given reports every 45 minutes until results are completely filed. Palm Beach County has refused to do this.

Finally, The Daily Caller News Foundation’s Luke Rosiak reported Saturday that lawyers for Nelson and Democratic gubernatorial candidate Andrew Gillum objected to non-citizen votes being thrown out during a review of provisional ballots.

The media has refused to admit the aforementioned improprieties could be an attempt to cover up fraud or that a lack of transparency makes fraud more likely.

CNN’s Chris Cuomo argued as much in an interview with Republican Florida Rep. Matt Gaetz on Friday night. Gaetz pointed out in response that “when litigants hide evidence or potentially destroy evidence, there are adverse inferences drawn against those litigants.”

Radio and HillTV host Buck Sexton pointed out the media’s willful ignorance of why there are real concerns about the vote-counting process in a tweet Saturday.

“Plenty of evidence of vote tampering and fraud, which is a precursor to election theft,” Sexton wrote. “The media is running narrative interference until the theft is achieved. Then it’s too late.”
